数字网络环境下版权权利穷竭原则延伸性研究

【摘要】：版权权利穷竭原则是版权法领域一项重要的原则,但在数字网络环境下,版权作品的发行和流通具有新的特征,第三人对其合法获得的作品原件或复制件的进一步处分也有别于传统意义上的转售或转赠,版权权利穷竭原则能否继续适用,是一个值得探讨的问题。由于版权权利穷竭原则在繁荣和发展作品二手市场、充分实现物尽其用、便于公众获取和保存作品、激励作者创新等方面的功效十分明显,因此,有必要将版权权利穷竭原则延伸适用于数字网络环境,确立适应数字网络环境特征的权利穷竭原则。
[Abstract]:The principle of exhaustion of copyright rights is an important principle in the field of copyright law, but in the environment of digital network, the distribution and circulation of copyright works have new characteristics. The further disposition of the original or duplicated works obtained by the third party is different from the resale or resale in the traditional sense. Whether the exhaustion principle of copyright rights can continue to be applied is a question worth discussing. Because the principle of exhaustion of copyright rights is very effective in prospering and developing the secondary market of works, fully realizing the best use of goods, facilitating public access to and preservation of works, encouraging authors to innovate, and so on, It is necessary to extend the principle of exhaustion of copyright rights to the digital network environment and establish the principle of exhaustion of rights adapted to the characteristics of digital network environment.
