网络音乐作品著作权集体管理制度研究

【摘要】：在著作权制度体系中,著作权集体管理制度占主要地位,而这也是随着不断发展的信息时代所产生的保护著作权的重要形式,它能较为妥当地处理著作权人及相关权利人在著作权的保护上的问题,并对我国法律体系的构建和法律制度的完善起到重要的作用。然而,即使我国音乐作品的著作权集体管理制度在保护著作权人和邻接权人和相关权利人的权益方面同样发挥了重要的作用,但是在数字化的今天,网络侵权现象层出不穷,著作权侵权比以往更加容易,公众网络侵权意识不高,我国著作权集体管理制度在新形势下实施起来的过程中存在着滞后的现象,网络音乐作品的著作权的集体管理更是使存在的问题与不足更尖锐突出:集中表现为如立法不够完善、集体管理组织分工不明确、专门性管理不够、公信力不够、著作权集体管理人才不够、科技创新不足、应对新时期著作权集体管理的监督力度不够等。今后我国应当继续注重学习国外的先进经验,从立法上来完善该制度,加强监督力度,注重科技创新、大力培养相关人才、培养公民保护意识。本文将从著作权集体管理制度的概念、内容、功能及法律依据等入手,在对比和分析国外一些国家的著作权集体管理组织的经验的基础上,提出网络音乐作品著作权集体管理面临的问题和应对的新举措和新方法。
[Abstract]:In the system of copyright system, the collective management system of copyright occupies the main position, and this is also an important form of copyright protection produced with the development of the information age. It can properly deal with the problems of copyright owners and related rights holders in the protection of copyright, and play an important role in the construction of the legal system and the perfection of the legal system in our country. However, even though the collective management system of music works in our country has played an important role in protecting the rights and interests of copyright owners, neighboring rights holders and related rights holders, the phenomenon of network infringement has emerged in an endless stream of digital today. Copyright infringement is easier than ever, public awareness of network infringement is not high, and the collective management system of copyright in our country is lagging behind in the process of implementation under the new situation. The collective management of the copyright of network music works makes the existing problems and shortcomings more acute and prominent: the concentrated expression is that the legislation is not perfect, the division of labor of collective management organizations is not clear, the specialized management is not enough, and the credibility is not enough. The talent of collective management of copyright is not enough, the innovation of science and technology is insufficient, and the supervision of collective management of copyright in the new period is not enough. In the future, our country should continue to pay attention to studying the advanced experience of foreign countries, perfect the system from the legislation, strengthen the supervision, pay attention to the scientific and technological innovation, train the related talents and cultivate the citizen's consciousness of protection. This article will start with the concept, content, function and legal basis of the copyright collective management system, on the basis of comparing and analyzing the experience of the copyright collective management organization in some foreign countries. This paper puts forward the problems faced by the collective management of the copyright of online music works and the new measures and methods to deal with it.
