已故作者著作人身权保护问题研究

【摘要】：无论是奉行“财产价值观”的英美法系还是坚持“人格价值观”的大陆法系国家,都对著作权人身权的重视程度越来越高,对于著作人身权保护的立法也日臻完善。著作人身权的保护远比著作财产权要复杂的多,因为它关乎作者的精神权利、人身利益、体现作者的思想感情、人格意志,同时肩负着保护作者权益与促进文化事业的发展双重重任。其中对于作者生前著作人身权的保护问题,理论界和实践中都有比较系统的研究,但是对于作者死后著作人身权的保护问题,学术界甚少讨论。笔者认为保护已故作者著作人身权问题有其重要的理论价值和实践意义。本文对已故作者著作人身权保护问题提出一些浅见,希望对已故作者人身权保护有所助益。本文除引言和结束语之外,共分为四部分:第一部分主要讨论作者死后对著作人身权的影响并提出问题,作者死后对作者的主体地位、权利归属以及著作人身权的行使与保护都带来一定的影响。第二部分主要讨论保护已故作者著作人身权的原因和权利归属问题。保护已故作者的著作人身权原因是作者的著作人身权能够突破民法权利能力樊篱,不因作者死亡而消灭的原因,并且对其保护有其重要的社会意义;通过对比“一元论”和“二元论”国家已故作者著作人身权的权利归属和保护期限,明确著作人身权不能继承,所谓著作人身权的“继承”实则“保护”。第三部分主要讲述已故作者著作人身权的行使,分别探讨已故作者的发表权、署名权和保护作品完整权的行使问题。第四部分讲述已故作者著作人身权的民事保护问题,分别讨论诉前行为保全、停止侵害、赔礼道歉和精神损害赔偿在已故作者人身权保护问题上的适用。
[Abstract]:Both the Anglo-American law system which pursues the "property values" and the civil law countries which adhere to the "personality values" have paid more and more attention to the copyright owner's personal rights, and the legislation on the protection of the copyright's personal rights has also become more and more perfect. The protection of personal rights of works is much more complex than that of property rights of works, because it concerns the author's spiritual rights, personal interests, reflects the author's thoughts and feelings, personality will, At the same time, shoulder the double responsibility of protecting the author's rights and promoting the development of cultural cause. There is a systematic study on the protection of the author's personal right in both theory and practice. However, there is little discussion in the academic circles about the protection of the author's personal right in postmortem works. The author believes that the protection of the personal rights of the deceased author has important theoretical value and practical significance. This paper puts forward some opinions on the protection of the personal right of the deceased author, hoping to be helpful to the protection of the personal right of the deceased author. In addition to the preface and concluding remarks, this paper is divided into four parts: the first part mainly discusses the influence of the author on the author's personal right after death and puts forward the question, the author's main position to the author after the death, The ownership of the right and the exercise and protection of the personal right of the author have brought certain influence. The second part mainly discusses the reasons for protecting the personal right of the deceased author and the attribution of the right. The reason of protecting the personal right of the deceased author is that the personal right of the author can break through the barriers of the right of civil law and not be eliminated because of the death of the author, and it is of great social significance to the protection of the personal right of the author. By comparing "monism" and "dualism", it is clear that the author's personal right cannot be inherited, and the so-called "inheriting" principle "protects" the author's personal right in the state of "monism" and "dualism". The third part mainly talks about the exercise of the personal right of the deceased author, and discusses separately the exercise of the deceased author's right of publication, signature and protection of the integrity of the work. The fourth part deals with the civil protection of the personal right of the deceased author, discussing separately the application of the preservation of the act before action, the cessation of the infringement, the apology and the compensation for moral damage in the protection of the personal right of the deceased author.
