对专利授权的重新审视——基于经济学视角的分析

【摘要】：专利制度是一种鼓励创新、促进创新成果传播和利用的法律制度。以专利法为核心的专利制度通过具体的法律制度设计来实现其制度宗旨。作为一种鼓励创新、进而促进经济社会发展的法律制度,专利制度也具有很强的经济理性,可以从经济学方面予以解构和认识。仅以专利授权为考察对象,尤其是其中的最优保护期限与最优保护宽度,亦能对专利法中的专利授权制度作出新的认识与理解,而这对于深刻认识专利法的制度精神也具有重要意义。
[Abstract]:Patent system is a legal system that encourages innovation and promotes the dissemination and utilization of innovation results. Patent law as the core of the patent system through the specific legal system design to achieve its system purpose. As a legal system to encourage innovation and promote economic and social development, patent system also has a strong economic rationality, which can be deconstructed and recognized from the aspect of economics. Only taking patent license as the object of investigation, especially the optimal protection period and the optimal protection width, it can also make a new understanding and understanding of the patent license system in the patent law. This is also of great significance to a deep understanding of the system spirit of patent law.
