地理标志类证明商标正当使用的研究

【摘要】：我国司法实践在认定地理标志类证明商标的正当使用时往往将其与普通注册商标正当使用的认定作相似处理。然而因地理标志类证明商标与普通注册商标不同,在认定地理标志类证明商标的正当使用时,应当从地理标志类证明商标的集体权利属性、地理标志类证明商标显著性程度较低、商业价值高等特点以及消费者对地理标志类证明商标辨识能力较弱角度出发,结合我国和域外的立法、司法实践,综合行为人是否成立主观善意、行为人的商品是否来源于地理标志类证明商标允许使用的地理区域范围、行为人是否在依照法律法规的要求描述产品的必要范围内非突出性地使用地理标志类证明商标、行为人行为是否会导致消费者混淆、是否利用了地理标志类证明商标的声誉以及地理标志类证明商标的知名度等各项因素,对于使用地理标志类证明商标的行为是否成立正当使用进行综合认定。在我国对地理标志采"双轨制"的保护体系下,出现地理标志类证明商标与地理标志产品权利冲突时,则应当侧重探讨行为人在使用相关标识时其使用行为的正当性,以此达到各方利益的平衡。基于此,在完善地理标志类证明商标正当使用制度的认定时,应当根据地理标志类证明商标的性质,在现有的商标法体系下,对地理标志类证明商标正当使用作出特别规定的同时,依据地理标志权的权利特征、我国关于地理标志保护的法律法规规范现状,借鉴域外法经验构建统一的关于地理标志保护的专门法。

Whether the reputation of the geographical indication certification trademark and the popularity of the geographical indication certification trademark are used to determine whether the behavior of the geographical indication type proof trademark is properly used or not is comprehensively identified. Under the protection system of "two-track system" for geographical indications in our country, when there is a conflict between the right of geographical indication type proof trademark and geographical indication products, we should pay more attention to discussing the legitimacy of the behavior of the doer when using the related signs. In order to achieve the balance of interests of all parties.
