论影视字幕组的法律界限问题

【摘要】：2014年11月22日,字幕组网站射手网突然宣布关站;12月20日,人人影视字幕组紧随其后,宣布永久关闭网站。两大字幕组同时关闭一时间成为网络上热议的话题。字幕组作为一种新兴的民间团体组织,在传播着外国影视文化的同时,也无时无刻不行走在法律规定的边缘,侵犯著作权的问题更是屡屡成为字幕组成员心口的一道伤口。本文从我国外文影视类字幕组的现状分析、涉及法律问题分析、其它国家(日本)的相似案例分析出发,尝试探讨外文影视类字幕组的合法性及其今后的发展方向。本文主要包括四个部分:本文第一部分主要从字幕组的发展阶段、工作流程、工作特点、不足之处等几个方面分析我国外文影视类字幕组的现状。第二部分探讨外文影视类字幕组的工作是否侵犯了著作权,同时其行为能否以合理使用进行抗辩。第三部分主要从日本的相似案例出发,介绍日本著作权法的相关规定及日本对于海外字幕组的态度,并从此角度出发,分析日本著作权法与中国著作权法在该问题规定上的不同点。第四部分着重分析了字幕组未来可发展的方向,并查阅了相关加拿大与美国的相关法条规定与判例支持。作者认为,字幕组作为一种新生事物,本身具有其积极的一面,在一定程度上借助互联网的大环境充当了文化交流的使者,另一方面,也确实存在侵权的可能性。而字幕组是否能在将来依旧为广大网民传播外文类优秀作品,取决于法律规制是否不断完善及字幕组自身能否实现转型。
[Abstract]:On Nov. 22, 2014, Sagittari.com, the caption group, abruptly closed the site; on December 20, Renren Movie and TV caption immediately followed, announcing the permanent closure of the site. The closure of the two caption groups at the same time has become a hot topic on the Internet. As a new kind of civil society organization, the caption group not only spreads the foreign film and television culture, but also walks on the edge of the law all the time, and the problem of infringing copyright has repeatedly become a wound in the hearts of the members of the caption group. Based on the analysis of the present situation of foreign film and television subtitles in China, the analysis of legal issues and the similar case analysis of other countries (Japan), this paper tries to explore the legitimacy of foreign film and television subtitles and its development direction in the future. This paper mainly includes four parts: the first part of this paper mainly analyzes the present situation of Chinese foreign film and television subtitle group from the development stage, work flow, working characteristics, shortcomings and so on. The second part discusses whether the work of foreign film and television subtitle group infringes copyright, and whether its behavior can be argued with reasonable use. The third part, starting from similar cases in Japan, introduces the relevant provisions of Japan's copyright law and Japan's attitude towards overseas alphabetical groups, and proceeds from this point of view. This paper analyzes the differences between Japanese copyright law and Chinese copyright law on this issue. The fourth part focuses on the future development direction of the caption group, and refers to the relevant Canadian and American legal provisions and jurisprudence support. The author believes that the caption group, as a new thing, has its own positive side, to a certain extent, it acts as an emissary of cultural exchange with the help of the Internet environment, on the other hand, there is indeed the possibility of infringement. Whether the caption group can still spread excellent works of foreign language for the majority of netizens in the future depends on the continuous improvement of the legal regulation and the transformation of the caption group itself.
