国有土地上房屋征收的立法透析与制度反思

【摘要】：国有土地上房屋征收这一行为之属性符合私法中的所有权社会化原则,其作为一种社会现实普遍存在于当下我国经济发展的进程之中,其背后蕴涵着深刻的私权保障要求。虽然《国有土地上房屋征收与补偿条例》在立法理念与技术上较原有法更为先进与合理,但在实体规制与程序设置上仍存有缺失,故公共利益的清晰界定、拆迁补偿标准的明确设立以及拆迁程序的细化规范是解决国有土地上房屋征收所出现问题的必由进路。
[Abstract]:The attribute of house expropriation on state-owned land accords with the principle of socialization of ownership in private law. As a social reality, it generally exists in the process of economic development in our country at present, and contains profound requirements for the protection of private rights. Although the regulations on expropriation and compensation of Housing on State-owned Land are more advanced and reasonable in legislative concept and technology than the original law, there are still deficiencies in the substantive regulation and procedural setting, so the public interest is clearly defined. The clear establishment of demolition compensation standard and the refinement of demolition procedure are the necessary ways to solve the problems of house expropriation on state-owned land.
