好意同乘引发的责任问题

【摘要】：随着社会经济的发展,人民生活水平的提高,汽车、摩托车等机动车已经在进入寻常百姓家。由于顺路,情谊关系等原因,驾驶人好意同乘亲人、朋友、甚至是不认识的人外出办理事务的情形也越来越普遍。善意的驾驶人是否有必要承担受惠人的安保责任,对其权利义务又是如何限制的,责任是如何分配的等等这些目前尚不明朗的问题。因此,笔者试图结合理论上的研究与实践中的判例,对好意搭乘的侵权问题进行探讨,以期得到一个相对全面的论述。
[Abstract]:With the development of social economy and the improvement of people's living standards, cars, motorcycles and other motor vehicles have entered the homes of ordinary people. Because of passing by, friendship and other reasons, it is more and more common for drivers to travel out to do business with relatives, friends and even people they do not know. It is not clear whether bona fide drivers need to bear the security responsibility of the beneficiary, how to limit their rights and obligations, how the responsibility is distributed, and so on. Therefore, the author tries to discuss the tort of good intentions by combining the theoretical research with the cases in practice, in order to get a relatively comprehensive discussion.
