我国《海上货物运输法》单项立法之思考

【摘要】:我国加入世界贸易组织已有十余年,不断深入的对内改革和不断扩大的对外开放,带来的是我国对外贸易量的不断增长,海上货物运输业进入了发展的辉煌期。但是到目前为止,我国却没有一部属于自己的单行的《海上货物运输法》,而相关法律规范也只是1991年颁布的《海商法》一部分相关内容而已,起草《海商法》之时中国的经济结构类型还未确定,这就造成了《海商法》中的部分内容受制于时势的限制,随着中国经济的发展,很多内容就过于落后,这一点在海上货物运输法律结构体系的系统性、独立性问题上尤其突出。在这一背景下,研究我国《海上货物运输法》单项立法问题便显得十分必要。笔者对海上货物运输以及与海运有关的法律内容进行了简述,分析了中外海上货物运输法的立法现状、特点,并给予了一定的评价,在此基础之上,主要是从我国海运业发展、国内《海商法》不足等方面论证了我国海上货物运输法单项立法的必要性,继而阐述我国海上货物运输法单项立法的可行性,最后给出了有关我国海上货物运输法几点具体的立法思考,这其中包括立法架构、对其他问题的处理等。理论上这一研究可以为海商法领域的理论发展注入新的思路;而实践上,该文创造性地提出如何在结合国内外理论研究与实践经验的基础上开展《海上货物运输法》单行立法的工作。总之,只有建立完整的海上货物运输法律规制体系,才能更有效地为我国海运业和外贸业的快速发展保驾护航。
[Abstract]:China has been a member of the World Trade Organization for more than a decade, and has been continuously deepening its internal reform and opening up to the outside world, which has brought about a continuous increase in the volume of our foreign trade. The maritime cargo transportation industry has entered a glorious period of development. But so far, However, China does not have a separate "Maritime cargo Transport Law" of its own, and the relevant legal norms are only part of the relevant contents of the "Maritime Law" promulgated in 1991. At the time of drafting the "Maritime Law", the type of China's economic structure has not yet been determined. As a result, some of the contents of the Maritime Law are subject to the constraints of the times. With the development of China's economy, many of the contents are too backward. This is a systematic point in the legal system of maritime cargo transport. Under this background, it is necessary to study the single legislation of China's Law on the Carriage of goods by Sea. The author gives a brief account of the contents of the law on the carriage of goods by sea and the related laws. This paper analyzes the legislative status and characteristics of Chinese and foreign maritime freight transport law, and gives a certain evaluation. On this basis, it mainly develops from the shipping industry of our country. In this paper, the necessity of the single legislation of China's maritime cargo transport law is demonstrated, and the feasibility of the single legislation of China's maritime cargo transport law is expounded. Finally, some specific legislative considerations about China's maritime freight transport law are given, which include legislative framework, treatment of other issues, etc. Theoretically, this research can inject new ideas for the theoretical development of maritime law; In practice, this paper creatively puts forward how to carry out the work of "Law of Carriage of goods by Sea" on the basis of theoretical research and practical experience at home and abroad. In short, only a complete legal regulation system of carriage of goods by sea should be established. In order to more effectively protect the rapid development of China's maritime industry and foreign trade.
