论海运货物控制权

【摘要】:有关货物运输的现行公约中,涉及航空、铁路和公路运输的公约均对货物控制权作了相应地规定。在海运领域中,虽然1990年《CMI海运单统一规则》和《CMI电子提单规则》均规定了货物控制权,但这两个规则的适用范围过窄,不能适应现代海运实践的需要。作为现存三大国际公约的替代品,,《UNCITRAL运输法草案》(以下简称《运输法草案》)规定了“货物控制权”的概念及其相关规则。本文试图通过研究“海运货物控制权”的相关内容,探讨中国引入这一制度的必要性和可能性。本文主要运用法的价值研究方法,从理论和实践两个方面,研究了货物控制权制度。 本文主要分为五个部分。第一章论述了我国引入货物控制权的必要性,并从法的价值的角度对货物控制权的价值进行分析。第二章是本文的主体,主要参照《运输法草案》,同时联系其他运输公约中关于控制权的规定,研究海运货物控制权的概念、主体、性质、行使条件等相关内容。第三章通过对中途停运权的简要研究,比较海运货物控制权与中途停运权之间的异同。虽然两者有形似之处,但它们在理论渊源、主体、内容、行使条件等方面存在的差异很明显。第四章总结《运输法草案》的规定可能存在的问题,虽然《运输法草案》的规定有助于解决货物运输发与货物买卖法之间的矛盾,但这些规定也并非严密和周全,这也是一直对《运输法草案》进行修改的原因。第五章主要探讨我国法律有关货物控制权的规定与完善建议。在我国的法律体系中,《海商法》未规定控制权制度,《合同法》第308条也只是关于控制权的一般规定,不能适应海运的特殊要求。 根据以上分析,笔者认为我们应借鉴《运输法草案》的成功之处,与时俱进,在我国的《海商法》中引入货物控制权,并且提出相关的立法建议。
[Abstract]:In existing conventions relating to the carriage of goods, conventions dealing with the carriage of goods by air, rail and road provide accordingly for the right of control of goods... in the field of maritime transport, Although the 1990 CMI uniform rules for Maritime bills and the CMI rules on Electronic Bills of Lading provide for the right of control of the goods, the scope of their application is too narrow. The draft UNCITRAL Transport Law (hereinafter referred to as "draft Transport Law") stipulates the concept of "right of control of goods" and its relevant rules. By studying the relevant contents of "right of Control over Maritime cargo", This paper discusses the necessity and possibility of introducing this system in China. This paper mainly uses the value research method of law to study the system of control right of goods from two aspects: theory and practice. This paper is divided into five parts. The first chapter discusses the necessity of introducing the right of control of goods in China, and analyzes the value of the right of control of goods from the point of view of the value of law. Referring mainly to the draft Transport Law, and in connection with the provisions of other transport conventions on the right of control, the paper studies the concept, subject, nature, and conditions of exercise of the right of control of maritime cargo. Chapter III, through a brief study of the right of stoppage in midway, This paper compares the similarities and differences between the control right of sea freight and the right of stoppage. Although they are similar in form, they are in the theoretical origin, subject and content. The differences in exercise conditions are obvious. Chapter IV summarizes the possible problems with the provisions of the draft Transport Law, although the provisions of the draft Transport Law help to resolve the conflict between the transport of goods and the law on the sale of goods. But these rules are not strict or thorough, This is also the reason why the draft Transport Law has been amended. Chapter five mainly discusses the regulations and suggestions on the right of control of goods in Chinese law. In the legal system of our country, the Maritime Law does not provide for the system of control rights. Article 308 of the contract law is also a general provision on control, Unable to meet the special requirements of sea transportation. Based on the above analysis, the author thinks that we should draw lessons from the success of the draft of Transport Law, keep pace with the times, introduce the right of control of goods in the Maritime Law of our country, and put forward relevant legislative suggestions.
