海商法视野下船长紧急处分职能行使问题研究

【摘要】：随着海上航行安全问题日益凸显,各国航运实务界逐渐重视海上航行的安全保障与管理问题。船长作为一艘船舶的最高领导人,其紧急处分职能的行使关系到整艘船舶的安全航行。尤其是发生危及船舶和船上人员财产等重大事故的情况下,船长紧急处分职能的正确行使对于打击船上违法犯罪活动、化解船舶所面临的航行危机起到了至关重要的作用。因此,研究船长紧急处分职能行使问题就更加具有必要性。本文围绕船长紧急处分职能的行使问题而展开,通过发现我国现有立法规范的不完善之处以及航行实践中所出现的事件和问题,并借鉴其他发达航运国家船长紧急处分职能行使的相关立法规范,来探究并完善《中华人民共和国海商法》下船长紧急处分职能行使的规范,最后进一步提出对现有规范的修正建议。第一章是对船长紧急处分职能行使问题的概述。在确定船长紧急处分职能含义的基础上概括其性质,并对该职能的具体范畴进行了深入的分析。第二章分析船长紧急处分职能的行使。该部分从船长紧急处分职能行使的条件入手,分析在实践中所产生的问题,进而对该问题进行原因分析。第三章对其他国家船长紧急处分职能的立法进行归纳并得出其借鉴要点。通过深入总结发达航运国家的相关立法规范,最终得出发达国家的相关法律规范对我国立法的借鉴之处。第四章在我国船长紧急处分职能行使的立法基础上提出完善建议。通过对我国《海商法》的立法条文进行深入的分析,阐述立法中所存在的问题并提出相关的立法建议。
[Abstract]:As the safety of maritime navigation becomes more and more prominent, many countries pay more and more attention to the safety and management of maritime navigation.As the supreme leader of a ship, the exercise of its emergency punishment function relates to the safe navigation of the whole ship.Especially in the case of serious accidents such as endangering the ship and the property of the person on board the ship, the correct exercise of the emergency punishment function of the captain plays a vital role in cracking down on the illegal and criminal activities on board the ship and resolving the navigation crisis faced by the ship.Therefore, it is more necessary to study the function of emergency punishment of captain.This paper focuses on the exercise of the emergency punishment function of the captain, by finding out the imperfections of the existing legislation and norms of our country and the events and problems that appear in the navigation practice.And draw lessons from the relevant legislative norms of the exercise of the emergency punishment function of captains in other developed shipping countries to explore and perfect the norms for the exercise of the emergency punishment functions of captains under the Maritime Law of the people's Republic of China.At last, the paper puts forward some suggestions to amend the existing standard.The first chapter is the summary of the exercise of the captain's emergency punishment function.On the basis of defining the meaning of the emergency punishment function of captain, the author generalizes its nature and makes a deep analysis of the specific scope of this function.The second chapter analyzes the exercise of the captain's emergency punishment function.This part starts with the condition of the exercise of the captain's emergency punishment, analyzes the problems in practice, and then analyzes the causes of the problem.The third chapter summarizes the legislation of emergency punishment of captains in other countries and draws the key points for reference.Through the in-depth summary of the relevant legislative norms of developed shipping countries, the author finally draws a conclusion that the relevant legal norms of developed countries can be used for reference in China's legislation.The fourth chapter puts forward some suggestions on the legislative basis of the exercise of the emergency punishment function of the captain of our country.Through the thorough analysis of the legislative provisions of Maritime Law of China, this paper expounds the problems existing in the legislation and puts forward some relevant legislative suggestions.
