【摘要】: 长期以来,无单放货行为中的相关责任主体承担的法律责任的定性一直困绕着理论界和司法实践部门,定性正确与否关系到案件的处理结果,定性不同必然导致法律适用、审判程序及判决结果的差异。本文试图从这个问题作为切入点,并结合我国《民法通则》、《海商法》、《合同法》的有关理论及相关规定,对无单放货的相关责任主体的法律责任应如何定性进行了详细论述。通过分析我国现行海商法的不足,以及针对我国的航运现状,提出了无单放货法律责任的一些解决方法,希望能够引起更多企业家和学者对无单放货从实务与法律角度进行深层次和比较全面的研究,以便对我国海商法立法的进一步完善与司法公正做出应有的贡献。 本文共分为四章。 第一章直接切入主题,分析了无单放货行为的责任主体如承运人、实际承运人、承运人的代理人以及港口经营人的法律责任应如何定性的问题。 第二章的内容是在第一章论述的基础上,对无单放货行为的赔偿责任进行分析,重点论述损失范围的确定和计算方法,承运人能否针对无单放货行为享受责任限制,承运人的相关抗辩理由。 第三章的内容是论述承运人在承担了无单放货责任之后的追偿问题。 第四章提出了无单放货法律责任的法律解决方法,以及提出减少无单放货现象的解决方法。
[Abstract]:For a long time, the qualitative nature of the legal liability assumed by the relevant subject in the act of releasing goods without bill has been trapped around the theoretical circle and the judicial practice department. Whether the nature is correct or not is related to the outcome of the case, and the qualitative difference will inevitably lead to the application of the law. The difference between trial procedure and judgment result. This article attempts to use this question as a breakthrough point, and combined with the relevant theories and relevant provisions of China's General principles of Civil Law, Maritime Law and contract Law, discusses in detail how the legal liability of the relevant liability subject should be qualitatively determined. Based on the analysis of the shortcomings of China's current maritime law, and in view of the shipping situation in China, this paper puts forward some solutions to the legal liability of shipping without bills. It is hoped that more entrepreneurs and scholars will make a deep and comprehensive study from the point of view of practice and law so as to make due contributions to the further improvement of maritime law legislation and judicial justice in China. This paper is divided into four chapters. In the first chapter, the author analyzes the liability of the carrier, the actual carrier, the carrier's agent and the port operator. The content of the second chapter is on the basis of the first chapter, on the basis of the analysis of the liability of undocumented delivery of goods, focusing on the scope of loss and calculation methods, whether the carrier can enjoy liability restrictions on the delivery of goods without documentary. Carrier's defence. The third chapter discusses the recovery of the carrier after assuming the liability of delivery without documents. The fourth chapter puts forward the legal solution of the legal liability and the solution to reduce the phenomenon of undocumented delivery.
