【摘要】:迟延交付制度从提出到发展见证了海上货物运输业的发展,它伴随着航海技术和世界经济的持续发展而不断完善,同时也体现了整个国际趋势和立法者在船东货主之间利益平衡中的立足和抉择。迟延交付制度最早并最先规定于1977年的《汉堡规则》,其规定使得在《海牙规则》和《维斯比规则》中有意回避和难以确定的有关迟延交付概念和经济损失等问题,有了明朗化的定性和法律依据,把迟延交付的概念彻底从“与货物相关的灭失和损害”中分离出来,这不失为立法中的先进之举,也有助于在海上货物运输的实务中,更好地维护船货双方的权益,从而为航运业的良性发展奠定了坚实的法律基石。 海上货物运输中迟延交付制度的出现是海商法的一大进步。随着全球经济化的不断加深,货物运输也在全球加速流动和运转。因而,货物利益方对承运人迟延交付的时间问题越来越重视。我国海商法非常明智地借鉴了《汉堡规则》中对迟延交付的相关规定,,建立起了具有我国特色的迟延交付制度。自1993年来,迟延交付制度已经历了10多年的实践检验。其中,出现了不少矛盾和问题,这些问题有时代背景造成的,也有规定的不细致造成的,更有立法者刻意回避造成的。已有不少学者从迟延交付制度本身出发,从制度上为迟延交付问题提出了很多合理的宝贵建议。因为法律条文的终极目的是要指导实践,本文尝试直接以迟延交付的索赔为主线,就法律适用以及实务中可能出现的问题进行了有针对性的分析,并发表自己不甚成熟的一己之见,以求我国的迟延交付制度能够更好地在实践中发挥其应有的作用。 文章共分为八个部分。第一章迟延交付概述,简要论述了迟延交付制度的提出、概念及其法律性质和归责原则,为下文的论述做准备。 第二章介绍了迟延交付索赔的主体,通过和国际上立法的比较可以看出我国立法的特点,并侧重论述了索赔方的适格主体问题,以避免不适格的索赔方不适当提出诉讼请求情形的发生,以便索赔方明确其地位,并节约了诉讼资源。 第三章介绍了索赔的诉讼时效和货方的通知义务。因为这也是索赔中必须要引起重视的问题,所以特地展开论述。 第四章分析了迟延交付损失的范围,着力对经济损失的赔偿范围展开了分析,目
[Abstract]:The late delivery system witnessed the development of the maritime cargo transportation industry from its inception to its development. It was continuously improved with the continuous development of navigation technology and the world economy. At the same time, it also reflects the international trend and the choice of legislators in the balance of interests between shipowners and shippers. The Hamburg rules, which were the earliest and first provided for in the late delivery system, in 1977, which provide for the deliberate avoidance and uncertainty in the Hague rules and the Visby rules of issues relating to the concept of delayed delivery and economic losses, With a clear qualitative and legal basis, the concept of delay in delivery has been completely separated from "loss and damage related to goods", which is an advanced step in legislation and contributes to the practice of the carriage of goods by sea. Better protect the rights and interests of both shipping and cargo, thus laying a solid legal foundation for the sound development of the shipping industry. The emergence of delay delivery system in the carriage of goods by sea is a great progress of maritime law. With the deepening of global economy, cargo transportation is also accelerating the flow and operation of the world. As a result, more and more attention has been paid to the delay of delivery by the carrier. The maritime law of our country has used the relevant provisions of the Hamburg rules for delay delivery very wisely and established the delay delivery system with Chinese characteristics. Since 1993, delay delivery system has experienced more than 10 years of practice test. Among them, there are many contradictions and problems, these problems are caused by the background of the times, but also caused by the provisions of the non-detailed, more deliberately caused by legislators avoid. From the point of view of delay delivery system, many scholars have put forward a lot of reasonable and valuable suggestions for delay delivery. Because the ultimate purpose of the legal provisions is to guide the practice, this paper attempts to directly take the delayed delivery claim as the main line, and makes a targeted analysis on the application of the law and the problems that may arise in the practice. In order to make the delay delivery system in our country play its due role in practice. The article is divided into eight parts. The first chapter is an overview of delay delivery, which briefly discusses the proposal, concept, legal nature and imputation principle of delay delivery system. The second chapter introduces the main body of the late delivery claim, through the comparison with the international legislation, we can see the characteristics of the legislation of our country, and focus on the suitably subject of the claimant. In order to avoid the improper filing of the claim by the unfit claimant, so that the claimant can clarify its status and save the litigation resources. The third chapter introduces the limitation of claims and the notice obligations of the parties. Because this is also a claim must be paid attention to, so the special discussion. The fourth chapter analyzes the scope of late delivery loss, and focuses on the scope of compensation for economic losses.
