【摘要】： 作为市场经济制度的一种重要工具,票据在经济生活中发挥着多种重要作用。随着商品经济的兴起和发展,票据被提出了更多功能的要求。相应的,票据制度也被逐步加以规范和完善。法律制度的建立,一方面保障了票据的有效流通和利用;另一方面,则赋予了票据事项的不同法律效力。上个世纪80年代,随着改革开放理念的大力倡导,随着紧闭国门的逐步打开,我国票据制度也得到了慢慢恢复。目前,大量的票据在我国经济生活中被企事业单位广泛使用,并且使用有据。随着票据在我国的推广使用和流通,出现了一些亟需解决和规范的问题,特别是在票据失票救济领域。由于现行法律、司法解释以及部门规章中,对于票据失票救济存在不甚明了甚至自相矛盾的规定,导致我国失票救济实务操作中存在某些争议。本文将从商法基础理论着手,综合运用结构分析、系统分析及实证分析等研究手段对我国票据失票救济途径进行法律分析与论证,并采取与大陆法系、英美法系等票据失票救济规定的比较法研究,在借鉴我国有关法学专家的相关研究分析成果、结合银行实务基础上,对一些操作模糊的问题作出个人解释,最后对我国票据失票救济制度完善提出了自己的建议。本文将按逻辑顺序,以递进式结构分四个章节进行论述。第一章将分析失票救济在我国的实然法路径,对我国三种票据救济途径的概念、特征、法律规定进行深入剖析和比较。第二章将围绕我国票据失票救济途径的立法以及实务缺陷进行展开分析。首先区分立法以及实务操作两方面,对失票救济途径的缺陷进行逐一罗列,最后一部分则围绕实务中的热点问题进行深入阐述,发现问题。第三章主要是对国外以及我国台湾、香港、澳门地区票据失票救济途径的立法体例进行探究和分析,并且提出可以借鉴的做法。第四章为本文重点。将着重探讨我国票据失票救济程序的可行性构想。通过立法对比、借鉴境外相关票据制度和规定,提出完善我国票据失票救济制度的具体建议。
[Abstract]:As an important tool of market economy system, bill plays a variety of important roles in economic life. With the rise and development of commodity economy, bills have been put forward more functional requirements. Accordingly, the bill system has been gradually standardized and improved. The establishment of legal system, on the one hand, ensures the effective circulation and utilization of bills; on the other hand, it endows different legal effects on bill matters. In the 80's of last century, with the vigorous advocacy of the reform and opening policy and the gradual opening of the closed country, the bill system of our country was gradually restored. At present, a large number of bills in our economic life are widely used by enterprises and institutions, and the use of evidence. With the popularization and circulation of bill in our country, some problems need to be solved and standardized, especially in the field of bill loss relief. Due to the existing laws, judicial interpretations and departmental regulations, there are some disputes in the practical operation of the relief for the loss of tickets in our country because of the unclear or even self-contradictory provisions on the relief of lost tickets. This article will proceed from the commercial law basic theory, synthetically uses the structure analysis, the system analysis and the demonstration analysis and so on research means carries on the legal analysis and the demonstration to our country bill lost the ticket relief way, and adopts with the civil law system, On the basis of the relevant research and analysis results of the relevant legal experts in our country and on the basis of the bank practice, the comparative law research on the relief provisions of the bill lost in the Anglo-American law system has made personal explanations to some problems of vague operation. Finally, some suggestions are put forward to improve the relief system of bill loss in China. This paper will be in logical order, the progressive structure is divided into four chapters. The first chapter will analyze the actual law path of the relief of lost ticket in our country, and make a deep analysis and comparison of the concept, characteristics and legal provisions of the three kinds of relief ways of bill in our country. The second chapter analyzes the legislative and practical defects of the remedies for the loss of bills in China. First of all, it distinguishes the legislation from the practical operation, and lists the defects of the remedies for the loss of tickets one by one. In the last part, the hot issues in practice are discussed in depth, and the problems are found. The third chapter is mainly to explore and analyze the legislative style of the relief ways of bill loss in foreign countries as well as Taiwan, Hong Kong and Macao, and put forward some methods that can be used for reference. The fourth chapter is the focus of this paper. This paper mainly discusses the feasibility conception of the relief procedure of bill loss in our country. Through legislation contrast, draw lessons from overseas relevant bill system and regulation, put forward the concrete suggestion that consummates our country bill lost ticket relief system.
