海上保险最大诚信原则之研究

【摘要】：诚实信用原则是民商法最重要的基本原则之一，是正义理念在民商法中的具体化。其含义是指在遵循交易道德的基础上，公正衡量当事人利益及当事人利益与社会利益，以及取得这些利益的平衡。在海上保险法中，，该原则的地位更加重要，被称之为所谓“最大诚信原则”。最大诚信原则实际上是法律对保险合同当事人具体诚信义务的概括，而保险人与被保险人的最大诚信义务则具体体现在有关法律规定与合同约定中。因此，只有对有关具体义务进行详细研究，才有可能准确把握最大诚信原则的具体内涵。本文对英国以及我国的相关法律现状进行具体研究和探讨，并对各自法律制度的优缺点加以分析。本文的研究对我国海上保险业和法律界人员了解我国和英国相关法律的现状，以及对我国海上保险法的立法和司法的不断完善具有一定指导意义。
[Abstract]:The principle of good faith is one of the most important basic principles of civil and commercial law and the embodiment of the concept of justice in civil and commercial law. Its meaning is to measure the interests of the parties, the interests of the parties and the interests of the society on the basis of following the transaction morality, and to obtain the balance of these interests. In the law of marine insurance, this principle is more important and is called the "principle of maximum good faith". In fact, the principle of maximum good faith is the generalization of the concrete bona fide obligation of the parties to an insurance contract by law, while the maximum bona fide obligation of the insurer and the insured is embodied in the relevant legal provisions and the contract agreement. Therefore, it is possible to accurately grasp the concrete connotation of the principle of maximum good faith by studying the specific obligations in detail. This paper studies and discusses the current situation of relevant laws in Britain and China, and analyzes the merits and demerits of their respective legal systems. The research of this paper has certain guiding significance for the marine insurance industry and the legal profession of our country to understand the current situation of the relevant laws of our country and England, and to improve the legislation and judicature of the marine insurance law of our country.
