海上货物运输法律制度的统一化研究

【摘要】:海上货物运输法律制度的统一化是国际贸易发展和航运实践发展的内在要求,是个曲折复杂的动态历程。 本文从介绍海上货物运输法的国际和国内渊源入手,分析了海上货物运输法的强制性效力特征及其对海上货物运输法律制度统一化的价值。三个海上货物运输法国际公约的内容差异,显示了当前海上货物运输法的混乱。通过对海运法领域最新通过的《鹿特丹规则》中创新内容和机制的分析,认为此公约并不能达成海运法的统一。在分析海上货物运输法律的国际立法冲突和国际立法与各国海商法之间的法律冲突后,表明了海上货物运输法统一化的必要性,并进一步指出船货双方力量分布情况的复杂,海上货物运输法的强制性和适用范围的有关争论等因素决定了统一化过程的艰难。在分析理论界关于海上货物运输法统一化方向观点的基础上,本文认为其中折衷的观点比较可取。此种观点有两种统一化方案,其中的《海牙—维斯比规则》修订方案由于是在目前接受国最多的海运公约上进行一系列合理合时的修订,没有超越国际海运实践,其折衷的做法易于被国际贸易界和海运界所接受,能够实现当前海上货物运输法律制度的统一
[Abstract]:The unification of the legal system of the carriage of goods by sea is the inherent requirement of the development of international trade and shipping practice, and is a complicated dynamic course. Starting with the introduction of the international and domestic sources of the law of carriage of goods by sea, this paper analyzes the characteristics of the mandatory effect of the law on the carriage of goods by sea and its value in unifying the legal system of the carriage of goods by sea. The differences in contents of the three international conventions on carriage of goods by sea show the confusion of the current law of carriage of goods by sea. Based on the analysis of the innovative contents and mechanisms of the newly adopted Rotterdam rules in the field of maritime law, it is concluded that this convention can not achieve the unification of maritime law. After analyzing the conflict of international legislation of the law of carriage of goods by sea and the conflict of laws between the international legislation and the maritime laws of various countries, this paper shows the necessity of the unification of the law of carriage of goods by sea, and further points out the complexity of the distribution of forces between the two parties. The compulsory nature of the law of carriage of goods by sea and the controversy about the scope of application determine the difficulty of the unification process. On the basis of analyzing the views of the theoretical circle on the unification direction of the law of carriage of goods by sea, this paper thinks that the compromise view is preferable. There are two harmonization options for this view, one of which the Hague-Visby rules revision programme has not gone beyond international maritime transport practice because it is a series of reasonably timely amendments to the maritime conventions that currently receive the largest number of States, Its compromise approach, which is easily accepted by the international trading and maritime communities, can bring about the unification of the current legal regime for the carriage of goods by sea.
