【摘要】： 破产是市场经济的必然产物。在整个破产程序中,破产管理人居于十分重要的地位,它具体管理破产中的各项事务,享有广泛的职权。破产管理人的活动直接关系到破产程序是否能公平、公正和高效地开始和终结。而由于特定社会背景,我国长期以来并无破产管理人制度,在新的破产法中虽然引入了该制度,但还是存在着一些明显的疏漏和不足之处.为此,笔者在比较分析国外关于破产管理人制度的基础上,结合我国的实际情况,对我国破产管理人制度中存在的一些问题,如破产管理人的选任制度、监督制度中的不足作了探讨分析,旨在为建立和完善破产管理人制度提供一些有益的意见和建议。
[Abstract]:Bankruptcy is the inevitable product of the market economy. In the whole bankruptcy procedure, the insolvency administrator is in a very important position. It manages the various affairs in the bankruptcy and enjoys a wide range of powers. The activities of the bankruptcy administrator directly relate to whether the bankruptcy procedure can be fair, fair and effective. There is no bankruptcy administrator system in the country for a long time. Although the system has been introduced in the new bankruptcy law, there are still some obvious omissions and shortcomings. For this reason, the author makes a comparative analysis of the foreign bankruptcy administrator system and combines with the actual situation of our country to ask some questions in the system of the bankruptcy administrator of our country. The problems, such as the selection and appointment system of the bankruptcy administrator and the insufficiency in the supervision system, are discussed and analyzed. The purpose is to provide some useful suggestions and suggestions for the establishment and improvement of the bankruptcy administrator system.
