无效民事行为效力转换制度研究

【摘要】：无效民事行为效力转换制度具有贯彻意思自治、实现公平、效益、维护交易安全的价值,也是一个具有广泛适用空间的制度,包括法律转换和解释转换两种。无效民事行为效力转换的适用事由包括意思表示瑕疵、内容违法、违背公序良俗、形式不合法等几种。就适用领域而言,无效民事行为效力转换可以适用于民法和商法的各个领域。考虑到立法现状,我国民法尤其是物权法应引入无效民事行为效力转换制度。
[Abstract]:The conversion system of invalid civil act effect has the value of implementing autonomy of will, realizing fairness, benefit and maintaining transaction security. It is also a system with wide application space, including legal conversion and interpretation conversion. The applicable reasons for the conversion of invalid civil act include the defect of the expression of intention, the illegal content, the violation of public order and good custom, the illegal form and so on. As far as the applicable field is concerned, the conversion of the effect of invalid civil act can be applied to all fields of civil law and commercial law. Considering the present situation of legislation, the conversion system of invalid civil action effect should be introduced in civil law, especially in real right law.
