略论承运人的过失免责

【摘要】:正 承运人的过失免责,是指承运人对引航员、船长、船员以及船公司雇佣的其他人在驾驶或管理船舶方面的过失或疏忽所造成的货物灭失或损害可以免除赔偿责任。因此,它只是相对于船长、船员、引航员或承运人的雇佣人员在驾驶或管理船舶上的行为、疏忽造或不履行契约而言的,如果是因管理货物上的过失所致的损失,承运人是不能免责的。目前在进出口贸易中,70—80%的契约都是通过海上运输这种方式完成的,因此,明确承运人的过失免责、范围及其适用条件,对于划清承运人与保险人之间的责任,保护收货人的合法权益,具有十分重要的意义。免责事项可分为两大类,一是过失免责,一是无过失免责。我国《海商法》第51条规定,在责任期间内因船长、
