学校行政行为之司法审查研究

【摘要】:随着国家法治进程的加快和法制理念的普及,学校学生的权利主体意识日益增强,涉及学生与学校行政行为之间的争议也逐渐增多。同时,我国教育法律法规和行政诉讼法对学校行政行为司法审查的相关规定极为模糊,导致司法实践中困境叠现,学生的权利得不到充分的救济。这一现象的逐渐增多,引发了学界的普遍关注与广泛争鸣。学校行政行为是否可以司法审查始终存在争议,迄今为止对这一理论的研究论述屈指可数。通过界定学校行政行为司法审查的范围,提出完善学校行政行为司法审查制度的具体措施。将理论与实践相结合,以人权保障、特别权力关系以及司法最终解决等理论为基础进行分析研究。学校行政行为司法审查制度的完善对维护学生权益,保障学校教学秩序,推动学校法治化进程与助力行政诉讼法之修改都有着重要的理论意义与现实价值。全文分为六个章节:第一章绪论,主要介绍了问题之提出以及研究学校行政行为司法审查之理论意义和实践价值,并列举了本文的研究方法。第二章学校行政行为及其司法审查概述,主要探讨了学校行为之分类、学校的定义及法律类型、学校行政行为的界定标准与分类以及学校行政行为司法审查的理论基础。第三章我国学校行政行为司法审查的现状分析,结合我国现有的立法规定和实践现状,对我国学校行政行为司法审查制度存在的困境及困境产生的根源进行剖析。第四章域外学校行政行为司法审查之理论与实践评析,对大陆法系、英美法系以及混合法系法治发达国家或地区的学校行政行为司法审查制度进行比较分析,结合我国实际国情,分析域外立法对我国完善学校行政行为司法审查制度的启示。第五章学校行政行为司法审查制度之完善,首先提出完善学校行政行为司法审查制度应遵循的基本原则,其次提出了立法模式之设定,最后从实体法和程序法两方面出发,提出立法之具体内容的完善措施。第六章结论,主要是对整篇文章的观点和结论进行归纳与总结。本文研究的重点是在阐释学校行政行为司法审查基本理论的基础上,探寻我国学校行政行为司法审查的立法困境及其原因,通过对域外法治先进国家、地区经验的借鉴,结合我国传统法律文化及当前国情,提出完善我国学校行政行为司法审查制度的具体建议。本文理论创新之处在于明确界定了学校行政行为司法审查的范围和审查标准。
[Abstract]:With the acceleration of the process of national rule of law and the popularization of the concept of legal system, school students' consciousness of subject of right is increasing day by day, and the controversy between students and school administrative behavior is increasing gradually. At the same time, The educational laws and regulations of our country and the administrative procedure law are extremely vague to the school administrative behavior judicial review related stipulation, causes the judicial practice difficult position to appear, the student's right does not have the sufficient relief. This phenomenon gradually increases. It has aroused widespread concern and widespread controversy in academic circles. There is always a dispute on whether school administrative acts can be reviewed by the judiciary. So far, the research on this theory is few and far. By defining the scope of the judicial review of school administrative acts, there is no doubt about whether school administrative acts can be subject to judicial review. Put forward the concrete measures to perfect the system of judicial review of school administrative act, combine theory with practice, protect human rights, On the basis of the theory of special power relationship and judicial final solution, the perfection of the judicial review system of school administrative behavior can safeguard the rights and interests of students and ensure the order of school teaching. It is of great theoretical significance and practical value to promote the process of school legalization and the modification of administrative procedural law. Chapter two summarizes the school administrative acts and their judicial review. This paper mainly discusses the classification of school behavior, the definition and legal type of school, the definition standard and classification of school administrative act and the theoretical basis of judicial review of school administrative act. Chapter three analyzes the present situation of judicial review of school administrative act in China. Combined with the current legislative provisions and the current practice of our country, this paper analyzes the difficulties and the root causes of the judicial review system of school administrative acts in our country. Chapter 4th analyzes the theory and practice of the extraterritorial judicial review of school administrative acts. This paper makes a comparative analysis of the judicial review system of school administrative behavior in developed countries or regions with civil law system, common law system and mixed law system, and combines with the actual situation of our country. This paper analyzes the enlightenment of the extraterritorial legislation to the perfection of the judicial review system of the school administrative act in China. Chapter 5th, the perfection of the judicial review system of the school administrative act, first puts forward the basic principles to be followed in perfecting the judicial review system of the school administrative act. Secondly, it puts forward the legislative model, and finally, from the substantive law and the procedural law, puts forward the improvement measures of the specific content of the legislation. 6th chapter conclusion, The main purpose of this paper is to sum up and summarize the viewpoints and conclusions of the whole article. On the basis of explaining the basic theory of the judicial review of school administrative behavior, this paper explores the legislative dilemma and its causes of the judicial review of the school administrative behavior in our country. By drawing lessons from the experiences of advanced countries and regions with the rule of law outside China, combining the traditional legal culture and the current national conditions of our country, This paper puts forward some concrete suggestions to perfect the judicial review system of school administrative behavior. The theoretical innovation of this paper lies in the clear definition of the scope and standard of the judicial review of school administrative act.
