参与分配制度在民事执行中的运用

【摘要】：参与分配制度是民事执行中的一项重要的制度，这项制度是从民事程序法的角度，，通过公力救济的方式保证债权人的合法权益受到法律的平等保护。虽然参与分配制度在民事执行中占有重要的地位，但是《中华人民共和国民事诉讼法》并未明文规定参与分配制度，我国现行法律仅是通过司法解释的形式规定了该制度，但是这些规定出台于20世纪90年代，已经不能适应社会发展的需要。当前，参与分配的主体范围、分配方式、查封制度以及诉讼保全措施在参分配中的效力四方面问题突显，通过对这些问题的深入剖析，立足于各国的经验，在加大立法的基础上，不断完善参与分配制度,进而使参与分配制度在民事执行运用中做到有法可依。
[Abstract]:Participation in the distribution system is an important system in civil execution. From the angle of civil procedure law, the system ensures the equal protection of creditors' legitimate rights and interests by means of public relief. Although the system of participation in distribution plays an important role in civil execution, the Civil procedure Law of the people's Republic of China does not explicitly stipulate the system of participation in distribution. The current law of our country only stipulates the system by way of judicial interpretation. However, these regulations were issued in the 1990 s, can not meet the needs of social development. At present, the main scope of participation in the distribution, the way of distribution, the system of seizure and the effectiveness of preservation measures in litigation are highlighted. Through the in-depth analysis of these problems, based on the experience of various countries, On the basis of increasing the legislation, the system of participation distribution should be perfected continuously, and then the system of participation distribution should be implemented according to the law in civil execution.
