【摘要】：人类法治进步的历史,就是一部私有财产权的法律保护史。从罗马法到美国的《独立宣言》再到法国的《人权宣言》以及其他国家的法律制度等等,他们的血管里无不渗透着私有财产权的保护,其与生命权、自由权一起被称为公民的三大基本权利,而且人权的最基本内容之一包含有私有财产权。由此可见,私有财产权的法律保护是何等重要。由于近几年来,随着我国经济的快速发展,随着我国现代城市建设的不断推进,在加快城市化进程和加大城市改造力度的同时,亦把我国的城市房屋征收推进了快速发展阶段,从而使得城市房屋征收成为近些年来的一个非常热门的话题。由于其与私有财产有着紧密的关联,故只要涉及到城市房屋征收,就不可避免地会遭遇到私有财产权的法律保护问题。而公民的私有财产权,在我国城市房屋征收的过程中,处理的好与坏,直接关系到被征收人的利益的得与失,直接关系到我国和谐社会的建设,同时还关系到我国法治建设的进程。为此,在城市房屋征收过程中,要强调私有财产权的法律保护作用。然而,由于我国目前有关城市房屋征收的法律、法规、规章以及规范性文件数量很多,且又不一致,不协调；在城市房屋征收的实践中政府扮演着举足轻重的角色,但因现有法律制度上的缺陷,对公益目的征收与商业目的征收并未做出严格的区分,再加上对政府在城市房屋征收之中所扮演的角色又缺乏科学,合理的定位,对政府的行为又缺乏有效的规范。为此,在城市房屋征收过程中,从立法着手,尽快建立和完善土地使用权和城市房屋征收的法律规范,以树立尊重和保护公民私有财产不受侵犯的法治理念,从而加强私有财产权法律保护的完善,从而培育出一个健康、有序的私有财产权的法律保护制度,这既是保护公民私有财产权的必然要求,亦是建设法治政府的理性选择。在城市房屋征收过程中,通过对私有财产权的法律保护和完善而加以研究。
