论中国宪法文化的现代化

【摘要】：由于多方面的原因,中国长期不具备实施宪政的基础,而宪政秩序的建成必须有相应的文化加以支撑。要加强中国的宪政建设,必须在立足本国国情的基础上借鉴西方国家优秀的宪法文化资源,从中汲取我国宪政建设必须之营养。笔者从剖析文化、宪法文化、现代化几个基本概念入手,沿着宪法文化的形成、宪法文化的近代化、宪法文化的现代化三个发展阶段,提出衡量宪法文化现代化的几个标准,并在此基础上结合中国的实际情况,论证中国宪法文化现代化的必备条件和实现途径。
[Abstract]:For many reasons, China has no foundation to implement constitutionalism for a long time, and the establishment of constitutional order must be supported by corresponding culture. Based on the national conditions of our country, we must draw lessons from the outstanding constitutional cultural resources of western countries, and draw on the essential nutrition of constitutional construction of our country. The author begins with the basic concepts of culture, constitutional culture and modernization. Along with the formation of constitutional culture, the modernization of constitutional culture and the modernization of constitutional culture, this paper puts forward several standards to measure the modernization of constitutional culture, and on this basis combines the actual situation of China. To demonstrate the necessary conditions and ways to realize the modernization of Chinese constitutional culture.
