论人大监督规范性文件之审查基准

【摘要】：宪法、立法法与监督法等确立的人大监督规范性文件的审查基准存在合法性标准简单化、合理性标准抽象化以及操作性标准漏洞化等问题,成为制约规范性文件备案审查健康发展的瓶颈之一。在借鉴作为宪法原则的比例原则内涵的三重审查基准基础上,人大监督规范性文件应建立"二领域三阶层"的审查基准,从而更好地适应新时代的法制统一和完善全国人大及其常委会宪法监督制度的要求。
[Abstract]:The criteria for the examination of the normative documents of the NPC supervision established by the Constitution, the Legislative Law and the Supervision Law have problems such as simplification of the legitimacy standard, abstraction of the rationality standard, and loophole in the operational standard. It has become one of the bottlenecks restricting the healthy development of the filing and examination of normative documents. On the basis of drawing lessons from the triple review standard of the connotation of the principle of proportionality as a constitutional principle, the people's Congress should establish a standard for the examination of "two fields and three classes". Therefore, it can better meet the requirements of the unification of the legal system in the new era and the improvement of the constitutional supervision system of the NPC and its standing Committee.
