农村基层民主建设的法制保障问题研究

【摘要】：通过观察我国基层民主的发展历程,可以发现:一方面,很多新力量正在成为民主化的巨大推动力;另一方面,法制的完善成为民主发展的重要前提。法制的健全和完善是民主发展的制度成果,又是民主发展的根本保障,因此,民主发展的过程也是法制健全和完善的过程。现在中国基层民主推进中出现的种种问题,归根结底需要法制建设来解决。推进我国基层民主的发展,需要以法制建设为根本途径。改革开放以来,我国的法制建设步伐很快,基层民主的相关法制体系基本建立。从1983年10月,中共中央、国务院发出《关于实行政社分开建立乡政府的通知》正式宣布了人民公社制度的终结,到1987年颁布《村民委员会组织法(试行)》,再到1990年9月国家民政部发布的《关于在全国农村开展村民自治示范活动的通知》,标志着村民自治制度进入正式运行阶段。一直到现在的《村民委员会组织法》和《选举法》的修改完善。这一系列的法律法规的制定和修改,使得农民群众的政治权利越来越完善,政治参与程度也是越来越高。但是现在只有一部《中华人民共和国村民委员会组织法》,相关配套法律总是不能及时出台。涉及千家万户的农村基层民主建设,没有具体的法律法规作为指导,恐怕难以顺利完成。这样的法制体系跟我们所设想的还有很大的差距。那么怎么来改善一下这样的局面?换个说法就是怎样认识到基层民主建设的法制保障的重要性以及它存在的缺陷,并且解决这样的问题,这就是本文所要探究与分析的。本文概括起来共分为三个部分,第一部分主要是对我国农村基层民主建设法治保障的理论依据及发展历程的介绍。包括一些基本理论阐述和法制建设的发展历程;第二部分写的是农村基层民主法制保障的现状与分析;包括农村基层民主法制保障取得的成就和存在的不足;第三部分是针对我国农村基层民主法制保障目前存在的问题提出具体的解决对策。主要是从立法方面、执法力度和司法方面给出一些方案。
[Abstract]:Through observing the development course of grass - roots democracy in China , it can be found that , on the one hand , many new forces are becoming the great impetus of democratization ; on the other hand , the perfection of the rule of law is the important precondition for the development of democracy .

Since the reform and opening - up , China ' s legal system construction has been very fast , and the relative legal system of grass - roots democracy has been basically established . From October 1983 , the State Council issued a circular on the separation of the local government from the Central Committee of the CPC Central Committee and the State Council .

But now there is only one Organic Law of the villagers committee of the People ' s Republic of China , and the relevant supporting laws can not be issued in time . There is no specific laws and regulations as a guide for the democratic construction of rural grass - roots in thousands of households . So how can we improve the situation ? How can we improve this situation ? This is how to recognize the importance of the legal security of the democratic construction of the grass - roots level and the defects that it exists , and solve such problems , which is to be explored and analyzed in this paper .

This paper is divided into three parts , the first part is the theoretical basis and the development course of the democratic construction of rural grass - roots democracy in our country , including some basic theories and the development course of the legal system construction . The second part is the present situation and analysis of the guarantee of the democratic legal system of the rural grass - roots level . The third part is to put forward concrete solutions to the problems existing in the rural grass - roots democratic legal system . The third part is to give some solutions to the legislation , law enforcement and judicial aspects .
