直面体育实践:体育法学研究的社科法学进路

【摘要】：以发表的《在路上:中国体育法学向何处去》与《刚刚在路上:再论中国体育法学向何处去》为蓝本,探讨了中国体育法学发展问题。近些年,中国主流的体育法学研究存在的一个问题是:未能直面中国的体育法治实践和诸多经验素材,研究语境日渐远离体育实践的现实场景,缺乏对体育法律问题与其他社会现象勾连关系的关注。基于此,笔者阐述了中国体育法学研究中理论构建本土不足、研究主题缺少对中国体育法制现实问题应有关注以及体育法学研究的是体育法律规范还是人及其体育实践等问题。研究认为:体育法学走的是建构理性之路。体育法运作根本上是人的体育实践,我们所要研究的是因体育而生之法,而非制定体育之法。未来中国体育法学发展应直面现实的体育法律现象、规律,可依循一条从实践出发的社科法学进路前行,以扩展研究体育法学问题的知识界限和方法论。
[Abstract]:Based on the published book "on the way: where to go in Chinese Sports Law" and "just on the Road: further discussion on where to go of Chinese Sports Law", this paper probes into the development of Chinese Sports Law. In recent years, one of the problems existing in the study of sports law in China is that it has failed to face up to the legal practice of sports in China and many empirical materials, and the research context is increasingly far from the realistic scene of sports practice. Lack of attention to the relationship between sports legal problems and other social phenomena. Based on this, the author expounds the lack of theoretical construction in the study of Chinese sports law, the lack of attention to the legal reality of sports in China, and the legal norms of sports or the people and their practice in the study of sports law. The study holds that: sports law takes the road of constructing rationality. The operation of sports law is basically the practice of human sports. What we should study is the law born from sports, not the law of making sports. In the future, the development of sports law in China should face up to the reality of sports law phenomenon and law, and follow a practical approach to social science law, in order to expand the boundaries of knowledge and methodology for the study of sports law.
