《国家监察法》的立法思路与立法重点

【摘要】：制定《国家监察法》是弥补现行监察制度不足的必然要求,是实现反腐制度化、法治化的客观需要,也是全面推进依法治国,实现国家治理体系和治理能力现代化的重要举措。制定《国家监察法》必须坚持正确的立法思想和立法导向,明确监察机关的定位和运作机制,实现对监察对象的全覆盖,完善监察手段和监察程序,强化对监察机关的监督和制约,设计好监察机关与司法机关的衔接机制,确保在法治轨道上推动改革。
[Abstract]:The formulation of the National Supervision Law is an inevitable requirement to make up for the shortcomings of the current supervision system, an objective need to realize the institutionalization of anti-corruption and the rule of law, and an important measure to comprehensively promote the rule of law and realize the modernization of the national governance system and governance capacity. In order to formulate the National Supervision Law, we must adhere to the correct legislative thought and legislative guidance, clarify the orientation and operation mechanism of the supervisory organs, realize the full coverage of the object of supervision, perfect the means and procedures of supervision, strengthen the supervision and restriction of the supervisory organs, design the convergence mechanism between the supervisory organs and the judicial organs, and ensure that the reform is promoted on the track of the rule of law.
