宜宾县扩权强镇试点改革探讨

【摘要】：改革开放以来,经济快速发展的“百强镇”、“千强镇”异军突起,但经济强镇的管理仍面临“职能缺失”、“权小责大”等问题。某些乡镇政府的经济社会管理权限已经不适应该地经济社会的发展需求,造成了乡镇治理结构和区域发展的矛盾。因此,倡导把一部分原属于县级政府的经济社会管理权限通过恰当的方式赋予乡镇政府的扩权强镇改革势在必行。当前国内学者从诸多角度探讨了扩权强镇改革实践,但结合西部省市的实际,进行个别案例的研究仍较少。本文结合笔者工作实际,运用政府间纵向分权理论、新公共管理理论等,对西部扩权强镇试点县宜宾市宜宾县展开调研。调研发现,宜宾县扩权强镇改革经历了三个时期,即试点镇的探索期、试点镇竞相发展期以及改革全域推进期。该县重点从“人权、事权、财权“着手,提升试点镇人事管理权、扩大行政管理执法权、提升财力保障等。经过一系列改革之后已初显成效,推动了权力重心的下移、壮大了县域经济、加快了新型城镇化的发展。然而宜宾县的扩权强镇改革却仍面临诸多难题,主要包括四个方面:第一,缺乏法律法规作支撑。扩权缺乏法理支持,造成“权小责大”等局面;权力的下放面临异化的威胁。第二,缺乏完善的体制作保障。试点镇现有机构无力承接事权,导致无力执行;少数部门放权不彻底,仅“虚有形式”;派出机构冗杂,“多头共管”降低了行政效率。第三,缺乏完善的人事制度。核定编制少制约着干部队伍建设;绩效考核缺乏系统性,不利于调动积极性。第四,缺乏有效的监督机制。县政府直接监管造成日常监督流于形式;司法监督因试点镇扩权,出现独立性下降等问题。结合宜宾县的实际情况,并借鉴国内外的成功经验,本文从四个方面提出了深化改革的建议。一是建议进一步依法科学放权。依法划分县乡职权,实现权责统一,结合各地实际科学放权。二是建议进一步加强扶持力度。试点镇应注重发展特色产业、量力而行,还应该注重生态文明建设;干部要解放思想,推动政府转变职能。三是建议进一步调整人事制度。合理设置机构和配备人员编制,完善绩效考核和奖励制度。四是建议进一步加强权力监督。完善镇级政务公开制度,健全镇级信访制度和监督体系等,保证权力的合法实施。
[Abstract]:Since the reform and opening up, the rapid economic development of the "100 town", "thousand A new force suddenly rises. Some economic and social management authority of township government is not suitable for economic and social development needs, causing a conflict the township governance structure and regional development. Therefore, it is imperative to promote economic and social management authority belongs to the part of the original county government to the township government through appropriate reform in the mode of expanding the right town. The current domestic scholars from different angles on expanding the right town reform practice, but with the actual western provinces, individual case study still less. In combination with the actual work, the use of government decentralization theory, new public management theory, carried out research on Yibin County West of Yibin City, expanding the right town research pilot counties. Found in Yibin County, expanding the right town reform has experienced three stages, namely the period of exploration pilot town, pilot town to develop and promote the reform of the global stage. The county focus from the "human rights, powers, property rights" to enhance the power of personnel management pilot town, the expansion of the administrative enforcement power, enhance the financial security. After a series of reform is beginning to show results, promote the power of the downwardness, strengthen the county economy, accelerate the development of new urbanization. However, Yibin county reform and expanding the right town but still faces many problems, mainly includes four aspects: first, the lack of legal support. The lack of legal support for power expansion "right, cause small responsibility" situation; the devolution of power to face the alienation threat. Second, the lack of perfect system security. The pilot town of existing institutions are unable to undertake duties, resulting in inability to perform a few departments; decentralization is not complete, only "hollow shape "Agency; jumbled," bull condominium "reduces the administrative efficiency. Third, the lack of perfect personnel system. The approval of less restricts the building of the contingent of cadres; performance appraisal lack of system, is not conducive to mobilize the enthusiasm. Fourth, the lack of effective supervision mechanism. The direct supervision of the county government caused the daily supervision of a mere formality; the judicial supervision for the pilot town to expand their power, problems reduced independence. Combined with the actual situation of Yibin County, and learn from the successful experience at home and abroad, this paper puts forward suggestion for deepening the reform from four aspects. One is that further decentralization. In accordance with the law science division of county authority according to the law, achieve unity responsibilities, with the actual situation of science the two is decentralization. Suggestions to further strengthen efforts to support. The pilot town should focus on the development of special industries, do, should also pay attention to the construction of ecological civilization; cadres should emancipate the mind, promote the transformation of government functions. The three is proposed to further adjust the personnel system. A reasonable set of institutions and staffing system, improve the performance appraisal and reward system. Four suggestions to further strengthen power supervision. To improve the township government affairs system, perfecting Township petition system and supervision system, ensure the implementation of legal power.
