公路经营企业乱收费的行政法律责任研究

【摘要】：为了促进公路事业发展，国家开始在基础设施领域引进企业资本，推出“贷款修路，收费还贷”政策。公路经营企业通过与政府部门签订公路特许经营权合同得以承担部分公共管理职能，参与公共产品与服务的提供。虽然公路事业因此得到发展，但也引起诸多收费乱象，长期得不到解决。欲解决长期困扰民众的公路乱收费问题，，应该从实际公路收费的主体入手，追究公路经营企业乱收费的行政法律责任。对此，本文分为三个部分来论述。第一部分对公路经营企业、收费权及其来源、乱收费的表现形式进行界定，并且阐述行政法律责任的归责原则与构成要件。第二部分指出公路经营企业乱收费被追究行政法律责任的不力情况及原因。第三部分则是针对上述情况所提出的相关完善建议。总体而言，包括完善义务性规定和责任性规定两大方面的建议。具体而言，包括公路经营企业应承担的行政法义务、责任追究主体、责任追究适用的程序以及责任形式等内容。
[Abstract]:In order to promote the development of highway industry, the state began to introduce enterprise capital in the field of infrastructure, and launched a "loan to build roads." The highway management enterprise can undertake part of the public management function by signing the highway franchise contract with the government department. Participation in the provision of public goods and services. Although the road industry has been developed, but also caused a lot of fees chaos, can not be solved for a long time. We should start with the main body of the actual highway toll, and investigate the administrative legal responsibility of the highway management enterprises to collect fees indiscriminately. For this reason, this article is divided into three parts to discuss. The first part is about the highway management enterprises, the right to collect fees and their sources. The manifestation of random charge is defined. The second part points out the weak situation and reasons of the road enterprises' arbitrary charges being investigated for administrative legal liability. The third part is put forward in view of the above situation. Suggestions for improvement. Overall. Including the improvement of obligations and responsibilities of the two aspects of the recommendations. Specifically, including the road management enterprises should bear the obligations of administrative law, accountability of the main body. The procedure and the form of responsibility should be applied.
