公路超限超载运输治理问题研究

【摘要】:随着我国经济的飞速发展,公路运输业也实现了跨越式升级。为满足运输和经济发展的需要,对道路环境和运输结构进行改善,从而使得我国运输量大大提高,同时,对我国经济的进一步发展也具有积极的作用。然而,由于运输量大、利益驱使等原因,当前超限超载现象日益增多。此种行为不但严重破坏了我国道路设施,减少了道路使用寿命,导致国家经济发生损失,而且危害了民众的生命安全。针对此情况,国务院发出文件,自2004年6月开始,交通部门等相关部门联合起来,共同对超限超载现象进行治理,力图消除超限超载现象。在一定时期内,该工作取得一定成效,国内超限超载现象大幅减少,但是,由于未建立有效的管理体系,相应的法律规定也不健全,导致超限超载屡禁不止。超限超载现象具有时间长、复杂程度高的特点,由此也就决定了治超工作的长期性,同时也需要完善的治理体系。在当前的情况下,针对超限超载问题,进行深入研究,提出相应的治理方案和解决措施,对维护我国道路运输稳定、国家经济发展具有积极的意义。本文选取江阴市为例,对该地区公路超限超载现象进行实地调查,并通过访谈和问卷的方法,对超限超载行为的主体进行调查,对其中存在的利益相关度进行探究,记录不同主体对超限超载行为的态度、认知以及相关建议,获取实际调查资料之后,对资料进行汇总和整理,并进行深入分析。本文运用文献研究法、实地调查与结构性访谈、问卷调查法等研究方法,从公路超限超载治理的问题提出和研究的意义入手,综合分析了国内外的研究现状,构建了本文的研究框架。同时,选取公共管理方面的众多理论,比如治理理论等,选取江阴市为研究对象,分析了江阴市当前超限超载运输治理存在的问题和原因分析,重点分析治超执法体系、源头治理、执法行为、治理手段等方面存在的问题及所对应的原因;分析超限超载现象存在的本质原因,探索相应对策,依照问题原因,结合交通行政执法的特点,试图从政府牵头多方参与、加强源头管理、加强执法队伍规范化建设、创新治超技术方法和完善相关法律法规等方面,提出切实可行的治超良策,从而进一步强化江阴市的治超工作力度,同时为相关研究与工作提供一些参考和经验。
[Abstract]:With the rapid development of China's economy, the highway transportation industry has also realized a leapfrog upgrade. In order to meet the needs of transportation and economic development, the road environment and transport structure have been improved, thus making the volume of transport in our country greatly increased, at the same time, It also has a positive effect on the further development of China's economy. However, due to the large volume of transportation and interest driven by other reasons, the phenomenon of overloading is increasing day by day. This kind of behavior not only seriously destroys the road facilities in our country, but also has a positive effect on the further development of our country's economy. The road service life has been reduced, resulting in the loss of the national economy and endangering the lives of the people. In response to this situation, the State Council has issued a document, beginning on June 2004, the transportation departments and other relevant departments have joined forces. In a certain period of time, this work has achieved some results, and the phenomenon of overloading in China has been greatly reduced. However, due to the failure to establish an effective management system, The corresponding laws and regulations are also not perfect, which leads to the repeated prohibition of overloading. The phenomenon of overloading has the characteristics of long time and high complexity, which determines the long-term nature of the treatment of overloading. At the same time, we also need a sound governance system. Under the current situation, in view of the problem of overloading, we should carry out in-depth research and put forward corresponding treatment plans and solutions to maintain the stability of road transport in our country. This paper selects Jiangyin City as an example, carries on the field investigation to this area highway overload phenomenon, and through the interview and the questionnaire method, carries on the investigation to the overload behavior main body, This paper probes into the relevant degree of interest, records the attitude, cognition and relevant suggestions of different subjects on overloading behavior, after obtaining the actual investigation data, summarizes and collates the data. Based on the methods of literature research, field investigation, structural interview and questionnaire survey, this paper analyzes the current situation of the research at home and abroad from the point of view of the significance of the research and the problem of highway overload control. At the same time, select many theories of public management, such as governance theory, select Jiangyin City as the research object, analyze the existing problems and reasons of Jiangyin overloading transportation management. Focusing on the analysis of the problems and the corresponding causes in the system, source, behavior and means of management, the essential reasons of the phenomenon of overloading are analyzed, and the corresponding countermeasures are explored, according to the causes of the problems, According to the characteristics of traffic administrative law enforcement, this paper tries to put forward practical and feasible measures to control traffic administrative law enforcement from the aspects of government leading multi-party participation, strengthening source management, strengthening the standardization construction of law enforcement team, innovating the technical methods and perfecting relevant laws and regulations, etc. It also provides some reference and experience for relevant research and work.
