基层工商行政执法工作的问题的研究

【摘要】：我国改革开放30多年来，市场经济蓬勃发展，市场经济体系在逐步完善，，但我国市场中还存在许多问题，需要强有力的监管。但中国基层工商行政执法过程中存在很多深层次的问题，对扰乱市场秩序的各种违法行为制止不力，损害了国家利益，也直接侵害了消费者和经营主体的利益。长期以来，工商行政管理工作沿用“收费型”管理模式，在很大程度上僵化了基层工作的思路，阻碍了工作的开展，淡化了工商行政管理工作应有的服务监管市场经济的职能，使其一度被误认为是收工商管理费的部门。停止征收“两费”后，基层工商管理工作面临巨大的挑战。基层工商所要尽快完成从“收费型”向“服务型”的职能转变，必须不断改革与完善监管体制，解决存在的问题，提高工作成效。工商行政管理是最具有中国特色的公共管理部门之一，是中国特色市场经济的重要组成部分，对基层工商行政执法工作中遇到的问题进行成因分析及解决对策的研究有非常重要的现实意义。因此，在明确了地方工商行政管理职能的前提下，分析并解决执法过程中遇到的问题就能有效的实现监管机制，才能将工商行政管理职能履行到位。现有的工商行政管理方面的研究，多侧重于宏观方面。行政执法是工商行政管理工作的重要环节，但是却很倾向于基层，更适合用微观的视角来进行研究。本人通过搜集和查阅了大量国内外市场监管和政策执行方面，特别是工商行政管理市场监管与政策执行的相关文献，并进行了整理，以“市场经济中的政府职能”、“行政法治理论”和“工商行政管理理论”为理论依据，对工商行政执法的微观层面，包括工商行政管理相关的法律法规不健全、制度不完善、干部队伍建设落后、执法环境恶劣等几个方面进行了分析，最后提出了相应的完善建议。
[Abstract]:Over the past 30 years or so since China's reform and opening up, the market economy has flourished and the market economy system has been gradually improved. However, there are still many problems in our market. Strong supervision is needed. However, there are many deep-seated problems in the process of enforcing the administrative law for industry and commerce at the grass-roots level in China, which has failed to stop all kinds of illegal acts that disturb the market order, thus harming the interests of the state. It also directly infringes on the interests of consumers and the main business bodies. For a long time, the industrial and commercial administration has followed the "fee-based" management model, which to a large extent ossifies the thinking of the grass-roots work and hinders the development of the work. It downplayed the function of service supervision and supervision of the market economy due to the work of industrial and commercial administration, so that it was once mistaken as the department that collects industrial and commercial administration fees. After the "two fees" were stopped, In order to complete the function transformation from "charge type" to "service type" as soon as possible, we must constantly reform and perfect the supervision system, solve the existing problems and improve the work effect. Industrial and commercial administration is one of the most important public management departments with Chinese characteristics and an important part of the market economy with Chinese characteristics. It is of great practical significance to analyze the causes of the problems encountered in the law enforcement work of industry and commerce at the grass-roots level and to study the countermeasures. Therefore, on the premise of defining the functions of local industrial and commercial administration, Analyzing and solving the problems encountered in the process of law enforcement can effectively realize the supervision mechanism and carry out the function of industrial and commercial administration. Most of the existing research on industrial and commercial administration has focused on the macro aspect. Administrative law enforcement is an important link in the work of industrial and commercial administration, but it tends to be at the grass-roots level. I have collected and consulted a large number of domestic and foreign market supervision and policy implementation, especially the industrial and commercial administration market supervision and policy implementation related literature, and collated, On the basis of "the government function in the market economy", "the theory of administrative law governance" and "the theory of industrial and commercial administration", the microcosmic aspects of industrial and commercial administrative law enforcement, including laws and regulations related to industrial and commercial administration, are not perfect and the system is not perfect. This paper analyzes the backward construction of cadre team and bad law enforcement environment, and finally puts forward some corresponding suggestions.
