农民工工资保障机制研究

【摘要】：农民工是我国特殊体制的产物。在我国社会保障体系整体尚不完善的情况下，由于劳动力市场的二元结构限制，与城市居民相比，，农民工在就业机会、工资待遇、工作条件、社会福利等各方面都存在着较大的差别。研究表明，尽管国家经济发展迅猛，但是农民工工资增长比较缓慢，而且拖欠、克扣农民工工资的现象比较普遍，农民工工资难以得到应有的保障。本文在对现场调查资料整理汇总的基础上，对农民工工资的现状进行了研究。本文认为，农民工工资拖欠问题的根源在于相关法律法规不完善、执法监管不到位、农民工缺乏组织和群体的帮助等。而农民工工资增长缓慢的原因则在于政府公共管理落实不到位，行政执法不力，相关的工资增长法律机制没有得到很好的执行等。这些现象都导致农民工工资得不到应有的保障。本文重点阐明的主要观点是——不能只把农民工工资问题看作是一个法律和经济问题，而应当成一个普遍的社会问题加以解决。文中从宏观建设和微观建设两方面提出了建立农民工工资保障机制的可行性措施。宏观建设方面包括政策性调控与监察导向、制度化约束与保障、企业战略性薪酬的规范化、信用制的社会化发展等四项内容。微观建设方面包括规范企业劳动用工、企业劳资管理流程化、强化农民工工资保障部门的执法力度等三项内容。通过本课题研究，可以为探讨农民工这一工业化进程中不可或缺的群体提供一个新的视角，为从社会经济发展的角度对当今社会农民工工资保障制度研究提供一定参考。
[Abstract]:Migrant workers are the product of our special system.Under the condition that the social security system in our country is not perfect, due to the restriction of the dual structure of the labor market, compared with the urban residents, migrant workers are in employment opportunities, wages, and working conditions.There are great differences in social welfare and other aspects.The research shows that although the national economy is developing rapidly, the wages of migrant workers are increasing slowly, and the wages of migrant workers are in arrears, the phenomenon of deducting migrant workers' wages is common, and the wages of migrant workers are difficult to be guaranteed.Based on the collection of field investigation data, this paper studies the status of migrant workers' wages.This paper argues that the problem of migrant workers' wage arrears is rooted in imperfect laws and regulations, inadequate enforcement and supervision, and lack of help from organizations and groups of migrant workers.The reasons for the slow wage growth of migrant workers are that the implementation of government public management is not in place, the administrative law enforcement is weak, and the relevant legal mechanism of wage growth has not been implemented very well.These phenomena lead to migrant workers' wages can not be guaranteed.The main point of this paper is that the issue of migrant workers' wages should not be regarded as a legal and economic issue, but as a general social problem.This paper puts forward the feasible measures to establish the wage guarantee mechanism of migrant workers from two aspects of macro construction and micro construction.Macroscopical construction includes four aspects: policy regulation and supervision, systematization restriction and guarantee, standardization of enterprise strategic salary, socialization development of credit system, etc.The micro construction includes three aspects: standardizing the labor and employment of enterprises, making the management of labor and capital flow, and strengthening the law enforcement of the wage security department of migrant workers.Through this research, we can provide a new angle of view for the discussion of migrant workers, an indispensable group in the process of industrialization, and provide a certain reference for the study of the wage security system of migrant workers from the perspective of social and economic development.
