杭州市行政服务中心运行机制研究

【摘要】:随着我国行政体制改革、行政审批制度优化的深入以及服务型政府理念的兴起,行政审批流程优化再造的课题被提上日程。行政服务中心的出现适应了当前变化,这种将各部门授权集中起来的方式在总体上实现了权力下放强度度和广度的增加。 国内关于行政服务中心的研究主要从公共管理、制度经济学、法学这三个视角切入并重点关注了行政服务中心产生的背景、功能、面临的问题、发展对策这几个方面的问题。国外对于行政服务中心的基本内容与国内大同小异,主要涉及行政服务中心的基本宗旨、面临的挑战、新型行政服务机构建设的必要性。 杭州市行政服务中心在取得良好成绩的同时也存在一定的运行障碍,主要包括:审批事项的机械整合、组织内部目标—行动的局部性冲突、组织内部共谋的事实不能、组织内关系的困境、绩效管理的缺陷、组织内部的资源利用不足,而引发行政服务中心这些运行障碍的诱因主要有以下几个方面:合法性不足、科层制结构的影响、部门的权力—利益枷锁。 在分析障碍以及相应原因的基础上,行政服务中心若要克服障碍,需要从完善相关的制度、运行框架;组织结构上的改革;加强对行政审批的再简化与监督。 透过以上的分析可以发现,其实行政服务中心的出现与运行背后隐含的是对权力的整合、重构与分配,这种公共服务形式是对既有权力结构和组织运行架构的创新尝试。 当然,窗口及其所属部门肯定会重视自身的服务职能,尽力为民众和企业做好工作,因为,无论怎样,部门将窗口派出之后必将直接与民众、企业存在各种互动,成为被监督点的延伸,窗口工作倘若存在问题为民众所不满投诉,那么也将影响整个部门的形象和效绩。但是,对于窗口的授权不足,必然会影响提供服务的质量和服务,影响外部对窗口的评价和质疑,所以,部门总是在不停的选择合适的点,而且目前并没有一个高效的法律依据对授权的情况进行规定和说明,使得服务工作的随意性更加大。 其实,只要有政治世界的存在,权利的博弈就不可能消除,而与权力连带的各种现象同样会层出不穷,无论政府部门对于结构、制度进行何种设计、修改和安排,最终很难改变这样的局面。但这并不意味着我们只能束手就擒,还是能够依靠力量进行调整,不断地实践能够推动政府工作、各种理论持续地向前发展,这种权力悖论反而是前进与发展的动力。
[Abstract]:With the reform of the administrative system, the deepening of the optimization of the administrative examination and approval system and the rise of the concept of service-oriented government, the issue of the optimization and reengineering of the administrative examination and approval process has been put on the agenda. The emergence of administrative service centres has adapted to the current changes, and this way of centralizing the delegation of authority across departments has generally resulted in an increase in the intensity and breadth of decentralization. The domestic research on the administrative service center mainly focuses on the background, function, problems and development countermeasures of the administrative service center from the perspectives of public management, institutional economics and law. The basic contents of administrative service center in foreign countries are much the same as those in China. They mainly involve the basic purpose of administrative service center, the challenge faced and the necessity of building new administrative service institution. At the same time, the Hangzhou Administrative Service Center also has certain operational obstacles, including: mechanical integration of examination and approval items, local conflicts between goals and actions within the organization, and the fact that there is no collusion within the organization. The predicament of the relationship within the organization, the defect of the performance management, the insufficient utilization of the resources within the organization, and the causes of these obstacles in the administrative service center mainly include the following aspects: lack of legitimacy, influence of the hierarchy structure, The power-benefit shackles of the department. On the basis of analyzing the obstacles and the corresponding reasons, if the administrative service center wants to overcome the obstacles, it needs to perfect the relevant system, run the frame, reform the organizational structure and strengthen the resimplification and supervision of the administrative examination and approval. Through the above analysis, we can find that the emergence and operation of the administrative service center implies the integration, reconstruction and distribution of power. This form of public service is an attempt to innovate the existing power structure and the organizational operation structure. Of course, the window and its departments will certainly attach importance to their own service functions and do their best for the public and enterprises, because, in any case, after the department sends the window out, it will definitely directly interact with the public and the enterprises. As an extension of the supervised point, problems in the window work will affect the image and performance of the whole department if they are complained about by the public. However, inadequate delegation of authority to the window will inevitably affect the quality and service of service delivery and the external evaluation and questioning of the window, so departments are constantly choosing the right points. Moreover, there is no efficient legal basis to regulate and explain the situation of authorization, which makes the work of service more arbitrary. In fact, as long as there is a political world, the game of rights cannot be eliminated, and various phenomena associated with power will emerge in endlessly, no matter what kind of design, modification and arrangement government departments make about the structure, system, etc. It will be hard to change that in the end. But this does not mean that we can only get caught without a hand, or can rely on the strength to adjust, constantly practice can promote the work of the government, various theories continue to develop, this power paradox is the driving force of progress and development.
