非正式制度因素影响下的利益冲突治理制度变迁分析

【摘要】:非正式制度是影响公职人员利益冲突治理制度变迁不可忽略的重要内生动力。作为制度内核的非正式制度价值观念、文化传统、伦理道德和习惯习俗等关键因素,影响和决定着现行颁布实施的利益冲突治理正式制度能否得到内在价值观念认同、政治生态文化支持、伦理道德自觉接受以及廉洁行为习惯遵循等。因此,推进非正式制度影响下公职人员利益冲突治理制度变迁,既要培育各类积极的非正式制度因素,以充分发挥其激励引导现行制度变革创新的诱致性制度变迁功能;还要通过渐进式变迁方式,实现非正式制度增量与正式制度存量的整体协调推进;最终通过非正式制度与正式制度有机结合、协调变迁与匹配支持,形成相容耦合推进利益冲突治理进程的制度约束合力,提升公职人员利益冲突治理实效。
[Abstract]:Informal system is an important endogenous power which can not be ignored to affect the governance of public officials' conflict of interest. As the core of the system, the informal institutional values, cultural traditions, ethics and customs and other key factors affect and determine whether the current formal system of conflict of interest governance can be recognized by the intrinsic values. The political ecological culture supports, the ethics morals self-consciousness accepts as well as the clean behavior custom obeys and so on. Therefore, under the influence of informal institution, it is necessary to cultivate all kinds of positive informal institutional factors in order to promote the institutional change of public officials' interest conflict, so as to give full play to the function of inductive institutional change which can stimulate and guide the innovation of the current system. Finally, through the organic combination of informal institution and formal institution, we can coordinate the change and matching support, and realize the overall coordination of informal institutional increment and formal institutional stock through gradual transition. Form compatible coupling to promote the conflict of interest governance process of institutional restraint, improve the effectiveness of public officials conflict of interest governance.
