宁波市鄞州新城区违章建筑协同治理研究

【摘要】:随着宁波城市化进程的快速推进,城市郊区土地陆续被征收,城乡结合部成为城市化、工业化的主要战场和重要阵地,原本处于城乡接合部的新城区迅速成为拆迁建设的热土的同时,也带来了另一“副产品”——违章建筑,并已逐渐成为鄞州区重点区块拆迁建设的绊脚石。如何有效控违查违、妥善处违问题已经引起各级政府的重视。尤其是2013年以来,浙江省、宁波市两级政府推进“旧住宅区改造、旧厂区改造、城中村改造、拆除违法建筑”(“三改一拆”)三年专项行动,下大决心破解空间制约之策、促进持续发展。在此背景下,本文运用统计分析、对比分析、规范分析和实证分析的方法,研究协同治理机制下违章建筑的治理之道。 本文第一部分对国内外研究的最新成果进行归纳梳理,,并对违章建筑的几个概念进行区分;第二部分运用公共管理理论中城市治理理论和协同治理理论,分析了我国城市治理理论的发展和协同治理理论运用于服务性政府的三大主体与四方面内容,继而推出“城管+村委”查违控违模式、“4+1”联合执法治理模式和参与式社会化治理模式,并对三种模型的可行性进行一定的评估;第三部分从城市管理行政执法的角度出发,阐述了鄞州新城区违章建筑的现状:违建现象面广量大点多、违章建筑主体不一、违章建筑形式多样、违章建筑用途各异,盘点了四大社会危害:①践踏政策,挑战法律权威;②破坏环境,扰乱社会秩序;③影响拆迁,消耗财政支出;④滋生事故,存在安全隐患。第四部分深入分析违章建筑产生、蔓延和屡禁不止的原因:①法制观念淡薄;②经济利益驱使;③疏通渠道不畅;④基层把关不严;⑤各方配合不力,并结合鄞州新城区违章建筑治理的情况分析当前环境下治理面临的五个挑战:①历史遗留问题多,情况错综复杂;②为建设及群众“刚需”,抵触情绪强烈;③违建面积小,搭建快,隐蔽性强;④拆违执行难,速度慢,效果差;⑤各部门协调性差,处理效率低。第五部分提出了违章建筑治理坚持分类处理、有序推进、多管齐下、教育与处罚相结合和集中整治与长效管理相结合的五大原则,并提出违章建筑治理的具体措施, 违章建筑的治理不可能一蹴而就,我们考察鄞州新城区违章建筑及对其治理工作的现状,分析违章建筑产生、蔓延的原因,其目的是反思现有的政策存在的问题,反思现有的法律法规体系存在的问题,反思在违建整治执法中存在的问题,希望能为改进鄞州新城区乃至类似的城乡结合部的违章建筑整治政策,完善相关的法律法规体系,规范执法行为,增强违建执法的成效提供切实有效、可操作性强的治理之道。
[Abstract]:With the rapid progress of urbanization in Ningbo, the suburban land has been expropriated one after another, and the urban-rural junction has become the main battlefield and important position of urbanization and industrialization. The new urban area, which was originally located at the junction of urban and rural areas, has quickly become the hot soil for demolition and construction, and at the same time, it has also brought another "by-product"-illegal building, and has gradually become a stumbling block for the demolition and construction of key blocks in Yinzhou District. How to effectively control violations and properly place violations has attracted the attention of governments at all levels. In particular, since 2013, Zhejiang and Ningbo municipal governments have carried out three years of special action to "renovate old residential areas, rebuild old factory areas, rebuild villages in cities, dismantle illegal buildings" ("three changes and one demolition") and make a great determination to crack down on space constraints. Promoting sustainable development In this context, this paper uses the methods of statistical analysis, comparative analysis, normative analysis and empirical analysis to study the governance of illegal buildings under cooperative governance mechanism. The first part of this paper summarizes the latest research results at home and abroad, and distinguishes several concepts of illegal architecture. The second part uses the theory of urban governance and cooperative governance in the theory of public management. This paper analyzes the development of urban governance theory and the application of cooperative governance theory to the three main bodies and four aspects of the service-oriented government, and then puts forward the "urban management village committee" to investigate violations of laws and regulations. The "41" joint law enforcement governance model and participatory socialized governance model, and the feasibility of the three models are evaluated. The third part starts from the perspective of urban management administrative law enforcement. This paper expounds the present situation of illegal building in Yinzhou New District: the phenomenon of illegal building is more extensive, the subject of illegal building is different, the form of illegal building is various, the use of illegal building is different, the trampling policy of four major social hazards: 1 is listed, and the legal authority is challenged; Destroying the environment, disturbing the social order, affecting demolition, consuming financial expenditure and breeding accidents, there are hidden dangers in safety. The fourth part deeply analyzes the causes of the emergence, spread and repeated prohibition of illegal buildings. The reason is that the concept of legal system is weak and the economic interests are weak. Combined with the situation of illegal building management in Yinzhou new urban area, this paper analyzes the five challenges that governance faces under the current environment: 1. There are many problems left over from history. The situation is complex and complex. 2. It is "rigid demand" for construction and the masses, and the resistance is strong and the building area for illegal construction is small. Fast construction, strong concealment, difficult to implement, slow speed, poor effect, poor coordination among departments, low processing efficiency. The fifth part puts forward the five principles of classified treatment, orderly promotion, multi-pronged approach, combination of education and punishment, and combination of centralized regulation and long-term effective management. And put forward the specific measures of illegal building governance, illegal building governance can not be achieved overnight, we investigate the Yinzhou New District illegal building and its governance work status quo, analysis of illegal building causes, spread, Its purpose is to reflect on the problems existing in the existing policies, the existing laws and regulations system, and the problems existing in the enforcement of illegal building regulations. It is hoped that it can provide an effective and operable way for improving the regulation policy of illegal construction in Yinzhou's new urban area and even for the similar urban and rural areas, perfecting the relevant laws and regulations system, standardizing the law enforcement behavior, and enhancing the effectiveness of the illegal building law enforcement.
