英国检察官培养制度及其启示

【摘要】:英国检察官培养制度的特点主要体现在检察官来源与分类遴选培训、检察官在任培养与考核、英国检察官职业伦理规范建设等方面。考察2011-2015年英国皇家检控署的运行状况发现英国检察官培养制度在人力资源管理、绩效管理、工作方式以及运作模式等方面都颇具特色。英国检察官培养制度存在种族歧视、与警察关系不睦、职业保障不足等问题,这些问题既是传统的种族旧习余毒的反映,也有固有的检警模式等原因。反思英国检察官培养制度,借鉴其合理因素,建议我国建立在法律职业共同体中的检察官遴选制度,构建适时、实效的检察官在任培训制度,建设全面与细致的过程与结果兼顾的检察官考核制度,塑造统一的检察官职业价值观以及构建"以人为核心"的检察官管理制度。
[Abstract]:The characteristics of the training system for prosecutors in Britain are mainly reflected in the training of the source and classification of prosecutors, the training and assessment of prosecutors in office. A review of the operation of the Royal Prosecution Service from 2011 to 2015 shows that the British Public Prosecutor's training system is in the fields of human resources management, performance management, and so on. The British prosecutor training system is characterized by racial discrimination, bad relations with the police, inadequate job security and so on. These problems are a reflection of the traditional racial tradition. There are also inherent reasons, such as the mode of procurator and police. This paper reflects on the training system of British prosecutors, draws lessons from its reasonable factors, and suggests that our country should establish a public prosecutor selection system in the legal professional community, and establish a timely and effective training system for prosecutors in office. To build a comprehensive and meticulous process and results of the procurator assessment system, shape the unified professional values of prosecutors and build a "people-centered" prosecutor management system.
