产权安排与保护:现代秩序的基础

【摘要】：本文尝试构建一个产权与社会秩序的框架,通过建立产权安排-产权保护-社会秩序之间的联系,帮助我们理解发展中国家绩效不佳的根源。已有理论强调了产权安排对经济绩效的影响,本文将这一研究延伸到产权的保护与实施,分析国家与其他主体互动中产权保护与实施的复杂性。沿着诺思等在权利开放与社会秩序演进方面的努力,本文进一步建立起产权理论与社会秩序研究的关联,分析产权安排及保护与社会秩序演进的关系。从产权与社会秩序的角度来看,发展中国家的落后主要是产权保护上的人格化以及从权利限制秩序向权利开放秩序转型的障碍。只有建立权利开放秩序,让所有公民享受同样的权利,将产权保护的范围扩大到全体公民,法律和政策对不同群体一视同仁,放开经济组织的准入与竞争,才能保持一个社会的长期、平稳、可持续发展。
[Abstract]:This paper attempts to construct a framework of property rights and social order, and by establishing the relationship between property rights arrangement, property right protection and social order, it helps us understand the root causes of poor performance in developing countries.The existing theories emphasize the influence of property rights arrangement on economic performance. This paper extends this research to the protection and implementation of property rights and analyzes the complexity of property rights protection and implementation in the interaction between the state and other subjects.Along with the efforts of North and others in the development of rights and social order, this paper further establishes the relationship between property right theory and social order research, and analyzes the relationship between property rights arrangement and protection and social order evolution.From the point of view of property right and social order, the backwardness of developing countries is mainly the personalization of property right protection and the obstacle of transforming from the right restriction order to the right opening order.Only by establishing an open order of rights, allowing all citizens to enjoy the same rights, extending the protection of property rights to all citizens, giving equal treatment to different groups in laws and policies, and liberalizing access to and competition in economic organizations,In order to maintain a long-term, stable and sustainable development of society.
