从集权式治理到开放式治理:封闭式小区的治理问题及其破解之路

【摘要】：中央关于街区制方案引发了封闭式小区是否应当开放的争论。支持开放者从城市交通、规划等宏观角度讨论街区制之利,反对者强调业主物权与生活便利。少有人注意到开放小区很可能是解决现有封闭式小区物业管理矛盾的路径。本文认为,封闭式小区特别是大中型封闭式小区居住模式是造成现在物业管理乱象背后的结构性因素。封闭式小区模仿当初单位大院而建立。单位大院具有品质与绩效的对比优势,但是需要匹配单一产权和单类成员基础上的科层制管理方式。商品房小区在开发阶段汲取了单一产权与科层制的制度优势,但是在物业管理阶段,由于多元产权、多类成员以及去科层制使得原有的制度优势丧失,带来一系列问题。这些问题的解决,需要开放式的治理方式。
[Abstract]:Central on the block system program triggered a closed community should be open to the debate. The authors support the discussion of the benefits of block system from the angle of urban transportation, planning and so on, while the opponents emphasize the owner's real right and convenience of living. Little attention has been paid to the open community is likely to be the way to solve the existing closed residential property management contradictions. This paper holds that the residential pattern of closed residential area, especially the large and medium enclosed residential district, is the structural factor behind the present disorder of property management. Closed quarter imitation of the original unit compound and the establishment. The unit compound has the comparative advantage of quality and performance, but it needs to match the single property right and the management mode of branch system on the basis of single class members. In the stage of development, the commercial housing district absorbs the system advantage of single property right and branch system, but in the stage of property management, the original system advantage is lost because of multiple property rights, multi-class members and delocalization system, which brings about a series of problems. The solution of these problems, need open management way.
