专利视角下的智能手机竞争态势研究

【摘要】:智能手机的技术竞争与发展速度日益加快,专利诉讼已经成为移动手机行业的普遍特征。回顾历史,这种诉讼更趋向于关注诸如无线电传输、网络管理和语言压缩技术等领域中提供传统移动语音服务的核心技术。最近,智能手机领域的诉讼,不断向更大的技术范围拓展,也产生了新的技术纷争。文章从专利的视角,结合专利计量与专利引文分析的方法,透过诉讼专利来分析当下智能手机的竞争状态,并窥探智能手机的未来竞争趋势。 文章以德温特专利数据库中的专利数据为基础,结合收集整理的智能手机诉讼案中的被诉讼专利,通过对智能手机领域专利的指标计量,利用信息可视化的技术,对智能手机的技术竞争状态进行分析与描述。同时,选取智能手机领域六大手机生产厂商,从专利申请数量以及专利被引频次两方面进行专利技术的比较,确定智能手机企业在不同技术领域中的地位。利用智能手机被诉讼的专利形成的专利引文网络,进一步确定智能手机领域专利诉讼关注的焦点技术领域及核心专利。 结果显示,智能手机领域的专利数量成逐年迅速增长的趋势,且主要的专利权人,绝大部分为当下智能手机市场中的主要手机生产厂商。而智能手机企业间的专利申请数量和专利被引频次有较大差距,综合两项指标,苹果公司虽然专利数量并不占据大多数,但其以高H指数和高被引频次,成为智能手机领域举足轻重的技术竞争对象。同时,在专利诉讼领域中,主要关注的技术集中于“触摸屏幕”、“移动数据传输”、“移动数据获取”和“面向对象的操作系统”四类,苹果公司牢牢把持着触摸屏幕技术领域的关键技术,并在智能手机诉讼网络中处于核心地位。由此,借助苹果公司使用的专利策略,主要有基本专利战略、专利转让策略及专利诉讼保护策略来窥探和预测未来智能手机的竞争趋势,即以触屏技术为代表的人机交互技术是研发重点;提供智能平台技术整合应用服务成为研发热点;加强关键技术领域专利整体布局成为争夺焦点。
[Abstract]:The technology competition and development speed of smart phones is becoming faster and faster. Patent litigation has become a common feature of mobile phone industry. Review history, this kind of litigation has tended to focus on the core technology of providing traditional mobile voice services such as radio transmission, network management and language compression technology. Recently, the field of smart phones From the perspective of the patent and the method of patent measurement and patent citation analysis, the competition state of the smart phone is analyzed and the future competition trend of smart phone is explored from the patent perspective and the method of patent citation analysis.
Based on the patent data in Derent's patent database, the article analyzes and describes the competitive state of the smart cell phone by using the technology of information visualization to analyze and describe the competitive state of the smart cell phone with the patent in the smart cell phone case collected and collated. The technology of information visualization is used to analyze and describe the competitive state of the smart phone. At the same time, six intelligent mobile phone fields are selected. Large cell phone manufacturers make a comparison of patent technology from two aspects of patent application and patented frequency, determine the position of smart phone enterprises in different technical fields. The patent citation network formed by patent of smart phone is used to further determine the focus of patent litigation in the field of smart phone. And core patents.
The results show that the number of patents in the field of smart phones is growing rapidly year by year, and the major patented owners are most of the main mobile phone manufacturers in the current smartphone market. There is a big gap between the number of patent applications and the frequency of patent cited among the smart phone companies, and the Apple Corp is patented though the Apple Corp is integrated. The number does not occupy the majority, but with high H index and high citation frequency, it has become an important object of technology competition in the field of smart phone. At the same time, in the field of patent litigation, the main technologies focus on "touch screen", "mobile data transmission", "mobile number acquirement" and "object oriented operating system", four types, The Apple Corp firmly holds key technologies in the field of touch screen technology and is at the core of the smart phone litigation network. Thus, with the help of the patent strategy used by Apple Corp, there are basic patent strategies, patent transfer strategies and patent litigation protection strategies to see and predict the future trend of smart phone competition, that is, The human-computer interaction technology represented by the touch screen technology is the focus of research and development, and the integration of application services of the intelligent platform technology has become the focus of research and development, and the focus of the competition is to strengthen the overall layout of the patent in the key technical fields.
