我国政府食品安全监管的角色研究

【摘要】:随着经济的快速发展和社会的不断进步,我国食品市场呈现出一片纷繁复杂的景象,食品的种类之多、数量之大都彰显着食品市场的繁荣,在如此多样化的食品中如何保证食品的安全性成为全社会共同关注的焦点。食品安全关系着民众的身体健康和生命安全,更关系着社会的稳定和国家的发展,但频繁发生的食品安全事件使得公众对于食品市场和政府监管能力越来越失去信心。因此,当前我国食品安全监管模式已不再适应食品市场的飞速发展,必须进一步完善。2013年3月,第十二届全国人民代表大会启动,“食品安全”作为重要的热点问题之一,成为政府工作中亟待解决的重大问题,为了更好地实现食品安全监管,新的机构改革方案中对食品安全监管机构和职能又一次进行了重大地调整,随后在2013年5月15日,中央机构编制委员会办公室公布了食品药品监督管理总局的“三定方案”,随着其职能逐步浮出水面,此次食品安全监管机构和职能的重大调整也有了更为明确的方向。 本文引用社会学中“角色理论”的四个层面,即角色期待、角色扮演、角色失调和角色整合作为分析框架,对政府在食品安全监管中的角色进行深入、详细的分析。从角色期待层面阐述了我国政府在食品安全监管中存在的必要性,以角色扮演中角色定位和角色实践两个角度为切入点,阐述了我国政府在食品安全监管中扮演什么样的角色--立法者和执法者,然后以“三聚氰胺奶粉”事件为主要案例,分析了我国政府食品安全监管中在立法角色和执法角色中存在的问题,并挖掘其原因。最后结合国际先进的政府食品安全监管经验,从角色意识、角色重建、角色让渡三个层面对我国食品安全监管的未来走势和发展方向提出了建议。
[Abstract]:With the rapid development of economy and the continuous progress of society, the food market of our country presents a complicated scene, the variety of food and the quantity of food show the prosperity of food market. In such a variety of foods, how to ensure the safety of food has become the focus of attention of the whole society. Food safety is related to the health and safety of the people, the stability of the society and the development of the country. However, the frequent food safety incidents make the public lose more and more confidence in the food market and the ability of government supervision. Therefore, the current mode of food safety supervision in China is no longer adapted to the rapid development of the food market and must be further improved. In March 2013, the 12th National people's Congress started, "Food Safety" as one of the important hot issues. To become a major issue to be addressed in the work of the Government, and in order to better achieve food safety regulation, the new institutional reform programme has once again made significant adjustments to the food safety regulatory bodies and functions, and subsequently on 15 May 2013, The Office of the Central Organization Establishment Committee announced the "three plans" of the Food and Drug Administration. As its functions gradually surfaced, the major readjustment of the food safety regulatory bodies and functions also took a clearer direction. This paper uses the four levels of "role theory" in sociology, that is, role expectation, role playing, role imbalance and role integration, as an analytical framework, and makes a thorough and detailed analysis of the role of the government in food safety supervision. This paper expounds the necessity of Chinese government in food safety supervision from the perspective of role expectation, and takes the role orientation and role practice as the starting point. This paper expounds what role our government plays in food safety supervision-legislators and law enforcers, and then takes the incident of "melamine milk powder" as the main case. This paper analyzes the problems existing in the role of legislation and law enforcement in the food safety supervision of our government, and excavates the reasons. Finally, combined with the international advanced experience of government food safety supervision, this paper puts forward some suggestions on the future trend and development direction of food safety supervision in China from the following three aspects: role consciousness, role reconstruction and role transfer.
