【摘要】：正1.科学界定政府事权范围。以法治原则规范政府、市场和社会各自的职能范围,合理界定政府事权。政府天然具有干预市场的内在倾向,由于长期的计划经济体制惯性,中国更甚。按照市场在资源配置中起决定性作用的基本原则,在《宪法》框架下,以《预算法》及各单项公共事业法律法规(如教育法等等)为基础,明确界定政府事权范围,并以"正面清单"约束政府,对政府而言是"法无许可不可为",对各类市场主体而言则是"法无禁止即可为"。2.合理、具体划分政府间事权。在明确政
