地方政府在企业破产中的角色定位分析

【摘要】：随着我国改革开放政策的逐步深入,市场经济逐步活跃和繁荣,企业破产也自之前的全面由政府主导变为现在由市场自行消化,通过国际通行的破产管理人制度,将整个破产运作交由更具专业性、独立性的破产管理人来处理,使破产程序更符合我国市场经济发展的规律。但是即便如此,由于政府对企业破产的态度和意识还没有完全转变,政府对企业破产的角色定位仍然存在着错位的情况,对企业破产行为的不当干预也依然存在。而近年来,受国际金融危机和国内局部金融风波的影响,我国中小企业普遍存在着生产经营困难的情况,由此引发温州两级法院的破产案件数量大幅攀升,更使得这些深层次的问题凸显出来。同时,法院在审理破产案件的过程中所遇到的诸多远远超越法院职权范围的困难和问题,却由于相关法律法规的缺乏,时常无法得到政府的协助与支持。本文着重从企业破产中政府的角色定位的角度入手,分析了企业破产中政府存在的缺位以及越位的情况,并提出了相关的意见和建议。
[Abstract]:With the gradual deepening of China's reform and opening up policy, the market economy is becoming more active and prosperous, and the bankruptcy of enterprises has also changed from being led by the government in the past to being digested by the market itself and through the international bankruptcy administrator system. Leave the whole bankruptcy operation to a more professional and independent bankruptcy administrator to make the bankruptcy process more in line with the law of the development of our market economy. But even so, As the attitude and consciousness of the government towards enterprise bankruptcy have not completely changed, the role of the government in the enterprise bankruptcy is still misplaced, and the improper intervention in the enterprise bankruptcy behavior still exists. And in recent years, Under the influence of the international financial crisis and the domestic local financial turmoil, there are generally difficulties in the production and operation of small and medium-sized enterprises in our country. As a result, the number of bankruptcy cases at the two levels of courts in Wenzhou has risen substantially. At the same time, many difficulties and problems that the court has encountered in the process of handling bankruptcy cases that far exceed the jurisdiction of the court, but due to the lack of relevant laws and regulations, From the angle of the role of the government in enterprise bankruptcy, this paper analyzes the absence and offside of the government in the enterprise bankruptcy, and puts forward the relevant opinions and suggestions.
