利益考量、规则意识与拆迁冲突的治理

【摘要】：拆迁安置引发的各种社会冲突已经成为令人瞩目的社会焦点问题。与以往学者研究的着眼点和逻辑进路不同,以利益自我实现要求的视角分析拆迁农民缺乏规则意识的深层次根源,可以得出结论:利益考量的精致化是拆迁农民缺乏规则意识的动因,利益比较的自我功利化是拆迁农民缺乏规则意识的起因。因此,基层政府治理拆迁冲突必须真正了解拆迁农民的利益需求,建立有效的利益协调机制,依法行政,培养拆迁农民的公民意识,如此方能实现基层治理现代化。
[Abstract]:All kinds of social conflicts caused by demolition and resettlement have become the focus of attention. From the perspective of self-realization of interests, this paper analyzes the deep-rooted causes of the peasants' lack of awareness of the rules, and concludes that the refinement of the consideration of interests is the reason for the peasants' lack of awareness of the rules. The self-utilitarianism of interest comparison is the cause of peasants' lack of awareness of rules. Therefore, the grass-roots government must truly understand the interests needs of demolition farmers, establish an effective interest coordination mechanism, and administer according to law. Cultivate the citizen consciousness of the farmer of demolition, so can realize the modernization of grass-roots administration.
