【摘要】：官员财产信息公开作为预防腐败的一项有效制度,目前已经在世界上许多国家和地区建立起来,并且普遍是以法律规范的形式加以规定和保障的。官员财产信息公开有利于发挥公众和有权机关对于政府工作人员的监督作用,建立起透明、廉洁的行政机构,体现了民主政治的要求。我国官员财产信息公开发展比较缓慢,仅有的一些制度规定也收效甚微。而与此同时,借助网络力量,官员腐败问题不断被公众以非制度化手段揭露出来,政府官员在公众心中的形象恶化,官员对网民的力量感到恐惧和不安。这种不正常的官民关系,严重影响着政治民主化和社会和谐。预防和惩治腐败,建设廉洁政治,是我们的党和政府一贯坚持的立场。十八大以来,党和政府回应社会期待,以“打铁还要自身硬”的坚定立场将反腐问题提到一个更重要的层面。在这样的大背景下,官员财产信息公开的步伐也必须加快起来。要通过学习借鉴其他国家和地区的经验,结合我国特殊国情和反腐工作实际,加快相关立法的进程,做好官员财产信息公开的过渡安排,完善具体制度设计,并与民商事配套制度形成合力,最终建立起有法可依、标本兼治、惩治与预防相结合的反腐制度。本文共分为五个部分。第一章主要介绍了官员财产信息公开的相关概念,对于官员、财产信息、申报和公开等重要概念做出了具体说明。第二章分析了官员财产信息公开的法理基础所在,即隐私权和知情权之间的冲突和协调。第三章对于美国、韩国以及中国澳门地区等几个国家和地区官员财产申报公示制度的具体实践和相关规定进行了分析,得出其制度建设对于我国的借鉴意义。第四章分别从目前我国行政法律法规、民事上隐私权的规定,以及主要民商事配套制度方面分析了我国官员财产信息公开的现状和存在的问题。第五章结合境外的经验和我国存在的问题,有针对性的提出了我国官员财产信息公开的完善建议,具体分为立法安排和具体制度设计两大方面。
[Abstract]:As an effective system to prevent corruption, the disclosure of official property information has been established in many countries and regions in the world. And it is generally stipulated and safeguarded in the form of legal norms. The disclosure of official property information is conducive to giving play to the supervisory role of the public and the competent organs over government functionaries and establishing a transparent and clean administrative body. It reflects the requirements of democratic politics. The disclosure of official property information in our country has developed slowly, and only some institutional provisions have had little effect. At the same time, with the help of the network, The problem of official corruption has been exposed by the public through non-institutional means. The image of government officials in the public mind has deteriorated, and officials are afraid and uneasy about the power of Internet users. This abnormal relationship between the government and the people, It is the consistent stand of our party and government to prevent and punish corruption and build clean politics. Since the 18th National Congress, the party and government have responded to the expectations of society. With the firm stand of "striking iron and being hard on its own", the anti-corruption issue has to be raised to a more important level. Against such a background, the pace of disclosure of official property information must also be quickened. We must learn from the experience of other countries and regions by studying and learning from other countries and regions. According to the special situation of our country and the reality of anti-corruption work, we should speed up the process of relevant legislation, make the transitional arrangement for the disclosure of official property information, perfect the design of specific system, and form a joint force with the supporting system of civil and commercial affairs, and finally establish a legal basis. This article is divided into five parts. The first chapter mainly introduces the related concepts of official property information disclosure, for officials, property information, The second chapter analyzes the legal basis of the disclosure of official property information, that is, the conflict and coordination between the right to privacy and the right to know. The specific practice and relevant provisions of the system of declaring and publicizing the property of officials in several countries and regions, such as South Korea and Macao, China, have been analyzed. The fourth chapter respectively from the current administrative laws and regulations, the provisions of the right to privacy in civil, As well as the main civil and commercial supporting systems, the paper analyzes the present situation and existing problems of the disclosure of official property information in China. Chapter five combines the overseas experience and the existing problems in our country. This paper puts forward some suggestions to improve the disclosure of official property information, which is divided into two aspects: legislative arrangement and specific system design.
