网络“微平台”条件下的行政监督研究

【摘要】：“微平台”作为一种新兴的移动网络平台,凭借其使用便捷、内容丰富等优势,从2009年微博诞生起就迅速发展。近年来,“微平台”在揭发检举违法行为、监督约束行政权力等领域发挥着越来越大的作用,成为行政监督体制中一股不可获缺的力量。“微平台”行政监督理论和实践内容的完善,有助于规范行政权力的使用,丰富行政监督手段,提高行政监督效率,提高我国民众法制化、民主化建设,将我国行政监督建设推向更高的层次。本文将“微平台”行政监督作为研究对象,全面分析“微平台”行政监督的本质及内涵。进而通过对大量案例的总结,归纳出“微平台”行政监督的形成、发展过程,现有运作模式,实现途径,以及“微平台”行政监督的特点及优势。在此基础上,继续探究“微平台”行政监督存在的问题和不足,发现当前“微平台”行政监督存在信息传播混乱、信息爆炸影响行政效率、极易形成“网络暴力”、绑架司法公正、运作模式单一、存在安全隐患等问题。针对以上问题,本文从理论和具体实践两方面提出解决办法,包括健全“微平台”行政监督预防机制、纠察机制、互动机制,与传统行政监督手段加强互补,以期为“微平台”行政监督建设提供借鉴。
[Abstract]:As a new mobile network platform, "micro platform" has developed rapidly since Weibo was born in 2009 with its advantages of convenient use and rich content.In recent years, the "micro-platform" is playing a more and more important role in the fields of exposing and reporting illegal acts and supervising and restricting administrative power, and has become an indispensable force in the administrative supervision system.The perfection of the theory and practice of "micro-platform" administrative supervision is helpful to standardize the use of administrative power, enrich the means of administrative supervision, improve the efficiency of administrative supervision, improve the legalization and democratization construction of Chinese people.The construction of administrative supervision in China will be pushed to a higher level.In this paper, micro-platform administrative supervision is taken as the research object, and the essence and connotation of micro-platform administrative supervision are comprehensively analyzed.Through the summary of a large number of cases, the paper concludes the formation, development process, existing operation mode, realization way of "micro-platform" administrative supervision, as well as the characteristics and advantages of "micro-platform" administrative supervision.On this basis, we continue to explore the problems and shortcomings of the administrative supervision of "micro-platform", and find that the current "micro-platform" administrative supervision has the confusion of information dissemination, the information explosion affects the administrative efficiency, and it is easy to form "network violence".Kidnapping judicial justice, operating mode is single, there are security hidden dangers and other problems.In view of the above problems, this paper puts forward two solutions from the aspects of theory and practice, including perfecting the "micro-platform" administrative supervision prevention mechanism, picketing mechanism, interactive mechanism, and strengthening and complementing with traditional administrative supervision means.In order to provide reference for the construction of micro-platform administrative supervision.
