政府购买公共服务合同管理能力问题研究

【摘要】：随着政府购买公共服务全面推开有了“时间表”,政府购买公共服务这一新型的服务提供方式将成为我国政府的一种常态化工作。全面推进政府购买公共服务不仅要发挥市场在资源配置中的决定性作用,而且对政府管理能力尤其是政府购买公共服务合同管理能力提出了新的要求。作为合同的签订方以及合同执行的监督者,政府如何处理好纵向权威模式与横向协商模式这种看似矛盾的关系,是合同管理能否成功的重要问题。本文首先在对国内外相关文献进行梳理的基础上阐释了政府购买公共服务合同管理能力的核心内涵、理论依据及其必要性,并试图从宏观、中观和微观三个层面较全面地分析政府在购买公共服务合同管理能力方面遇到困境的表现及其原因。本文认为,政府购买公共服务合同管理能力存在不足的原因主要有以下五个方面：市场经济发展不充分、政府职能转变不彻底、传统官僚制文化与现代契约文化的冲突、合同管理的运行机制不健全、合同管理者的素质和水平的不适应性等。然后,作者试图借鉴美英日德四国在政府购买公共服务合同管理能力方面的有益经验,探讨了提升我国政府购买公共服务合同管理能力的基本对策：第一,以完善相关法律法规体系为基础,营造良好的行政生态和法治环境；第二,以充分发展市场经济为立足点,形成健全的市场经济体制；第三,以塑造理性契约文化为关键点,克服传统官僚制文化等意识形态的长期掣肘；第四,以强化政府自身建设为中心,运用各种方式提高合同管理者的素质和能力；第五,以着眼整体性开发为落脚点,建立健全政府购买公共服务合同管理体系等。
[Abstract]:With the "timetable" of government purchasing public service, it will become a normal work for our government to purchase public service.To push forward the purchase of public service by government in an all-round way, we should not only give play to the decisive role of the market in the allocation of resources, but also put forward new requirements for the ability of government management, especially the ability of government to purchase public service contracts.As the signatory of the contract and the supervisor of the execution of the contract, how to deal with the seemingly contradictory relationship between the vertical authority model and the horizontal negotiation mode is an important issue for the success of the contract management.This paper firstly explains the core connotation, theoretical basis and necessity of the management ability of government purchasing public service contract on the basis of combing the relevant literature at home and abroad, and tries to make a macro view of it.This paper comprehensively analyzes the performance and reasons of the government's difficulties in the management ability of purchasing public service contracts at the three levels of meso and micro.In this paper, the author holds that there are five main reasons for the insufficiency of the management ability of the government in purchasing public service contracts: the insufficient development of the market economy, the incomplete transformation of the government functions, the conflict between the traditional bureaucratic culture and the modern contract culture.The operating mechanism of contract management is not perfect, and the quality and level of contract managers are not adaptable.Then, the author tries to draw lessons from the beneficial experience of the four countries of the United States, Britain, Japan and Germany in the management ability of the government to purchase public service contracts, and probes into the basic countermeasures to enhance the management ability of our government to purchase the public service contracts: first,Based on the improvement of relevant laws and regulations system, to create a good administrative ecology and legal environment; second, to fully develop the market economy as a foothold, to form a sound market economic system; third, to shape the rational contract culture as the key point,To overcome the long-standing constraints of traditional bureaucratic culture and other ideologies; fourth, to strengthen the government's own construction as the center, using various ways to improve the quality and ability of contract managers; fifthly, to focus on holistic development as its foothold.Establish and improve the government purchase of public service contract management system.
