面向政府购买服务的建设工程第三方检查机制研究

【摘要】：目前,我国国情持续发生深刻变化,为有效应对经济下行压力,国家出台了一系列措施,加大政府基建工程投资。因此,保证工程质量安全、建立高效的政府投资建设工程监管模式尤为重要。一方面,由质监站、安监站从事建设工程监督的监管模式难以适应日益扩大的基建规模与先进的建设技术;另一方面,推广政府购买服务、加快政府职能转变,成为我国深化改革的主要方向。因此,研究并建立面向政府购买服务的建设工程第三方检查机制,很有必要。首先,分析了我国建设工程政府监管现状,结合相关学者对其改进建议、第三方检查模式的发展及现有政府购买建设工程服务应用,提出面向政府购买服务的建设工程第三方检查概念并进行科学定义;界定其适用范围、检查对象、检查范围;从检查范围与检查者性质对比其与质安站检查的区别,并提出了应用政府购买建设工程第三方检查服务的实践意义。其次,论证面向政府购买服务的建设工程第三方检查的合规性。基于现行法律、法规、规范性文件分析政府购买服务界限,应用法律优先与法律保留原则论证政府购买建设工程第三方检查服务的合规性,探讨政府、社会力量、检查对象的三元关系,并梳理政府购买阶段、合同缔约阶段、合同履行阶段该行为的法律依据框架图,使其有法可依。分析了目前政府购买第三方检查服务应用过程中遇到的法律困境,并提出相应对策。第三,探索政府购买建设工程第三方检查服务的合同机制。明确了政府职能的合理委托范围与委托期限,划分了政府委托人、检查方、被检查方三方的权利、责任与义务。建立检查单位招投标阶段、检查服务合同实施阶段流程模型图,并对制定计划阶段、前期决策阶段、项目实施阶段和结算审计阶段建立详细的子模型图、表。最后,以郑州某区建设行政主管部门对新区基础设施工程建设购买第三方检查服务为例,详细介绍此次购买第三方检查服务的工作模式与机制特点,并在此基础上对现有的第三方检查服务运行模式进行分析,探索改进方向、提出改进意见。
[Abstract]:At present, China's national conditions continue to undergo profound changes, in order to effectively cope with the downward pressure of the economy, the state has issued a series of measures to increase government investment in infrastructure projects.Therefore, it is very important to ensure the quality and safety of the project and to establish an efficient supervision mode of government investment and construction project.On the one hand, it is difficult to adapt the mode of supervision by quality supervision stations and safety supervision stations to the ever-expanding scale of infrastructure construction and advanced construction technology; on the other hand, to promote the government to purchase services and speed up the transformation of government functions.Become our country deepens the main direction of reform.Therefore, it is necessary to study and establish a third-party inspection mechanism for government-purchased services.First of all, this paper analyzes the current situation of government supervision of construction projects in China, and combines the suggestions of relevant scholars, the development of third-party inspection model and the application of the existing government purchase of construction engineering services.This paper puts forward the concept and scientific definition of third-party inspection of construction project for government purchase service, defines the scope of application, the object of inspection, the scope of inspection, compares the scope of inspection with the nature of inspector and compares it with the inspection of quality and safety station.The practical significance of using government to purchase third-party inspection service of construction project is put forward.Secondly, demonstrate the compliance of third-party inspection of construction project for government purchase services.Based on the existing laws, regulations and normative documents, this paper analyzes the boundaries of government purchase of services, applies the principle of legal priority and legal reservation to demonstrate the compliance of the government in purchasing third-party inspection services for construction projects, and probes into the government and social forces.This paper examines the ternary relationship of the object, and combs the framework diagram of the legal basis of the act in the stage of government purchase, the stage of contract signing and the stage of contract performance, so that it can be governed by law.This paper analyzes the legal difficulties encountered in the process of government purchasing third party inspection service and puts forward corresponding countermeasures.Third, explore the government purchase construction project third-party inspection service contract mechanism.This paper clarifies the reasonable entrustment scope and the entrustment period of the government function, and divides the rights, responsibilities and obligations of the three parties: the government client, the inspector and the inspected party.Establish the inspection unit bidding stage, check the service contract implementation stage process model diagram, and establish the detailed sub-model diagram, table for the planning stage, the early decision stage, the project implementation stage and the settlement audit stage.Finally, taking a district construction administration department in Zhengzhou as an example to purchase third-party inspection services for infrastructure construction in the new district, the working mode and mechanism characteristics of the purchase of third-party inspection services are introduced in detail.On the basis of this, the paper analyzes the operation mode of the third party inspection service, explores the direction of improvement, and puts forward some suggestions.
