我国事故调查的主要问题与调查模式的转变

【摘要】：运用行政过程论可以系统地分析我国事故调查中存在的调查目的自相矛盾、调查主体不具独立性、正当程序严重缺失、调查报告不公开、安全建议得不到落实五大问题。这些问题严重影响了事故调查"防止类似事故再次发生"目的的实现。解决问题的方案是改革我国事故调查体制,将目前的事故调查过程分解为"安全调查"和"责任调查"两个独立的调查过程,组建独立机构进行"安全调查",由其它具有行政监督管理权限的部门负责"责任调查",实现事故调查由"合并模式"向"分立模式"的转变。
[Abstract]:By using the administrative process theory, we can systematically analyze five major problems existing in the investigation of accidents in our country, such as the self-contradiction of the purpose of investigation, the lack of independence of the subject of investigation, the serious lack of due process, the closed investigation report and the failure to carry out the safety recommendations. These problems have seriously affected the achievement of the purpose of accident investigation "preventing similar accidents from happening again". The solution to the problem is to reform the accident investigation system in our country, and to decompose the current accident investigation process into two independent investigation processes, namely, "safety investigation" and "responsibility investigation". Set up an independent organization to carry out "safety investigation", with other departments with administrative supervision and management authority in charge of "responsibility investigation", and realize the transformation of accident investigation from "merger mode" to "separate mode".
