中国政府网络监管存在的问题与对策研究

【摘要】：现如今是网络高速发展的时期,人们的日常生活、工作与网络的关系都是密不可分的,网络逐渐成为人们生活的重要工具,伴随着人们的衣食住行。鉴于网络具有开放性、安全性、风险性等特点,互联网在提高社会生活水平的同时给政府网络监管带来了诸多挑战。随着互联网的蓬勃发展,各种技术问题甚至是社会问题不断增多,如信息泄露、黑客攻击、网络侵权、网络犯罪等。政府作为社会发展的核心,对网络的监管力量不容小觑,除了制定法律实施政策外,对其他社会组织的监管也应起引导作用。因此,对网络实施有效监管有助于网络的良性运行,有助于提升政府的管理职能,对我国社会的不断进步有所帮助。不同领域的国内外专家学者对网络监管的研究日益增多,对网络监管的体系、机制、责任和困境等方面进行了深入细致的研究。本文试图结合现有研究成果,通过介绍中国网络监管的发展情况,分析网络监管中的问题成因,以政府为主体,制定完整监管机制。除绪论外,本文分为四个部分:第一章关于政府网络监管相关理论概述,阐释了网络监管和政府网络监管的定义,同时对网络监管的原则、模式特点和演进过程进行了分析,理论上拟采用网络空间的规制理论、治理理论和言论自由理论作为此论文研究的理论支撑;第二章首先分析了中国政府网络监管的现状,然后从法律法规、网络监管主体、网络监管技术及网络监管的实施几个方面来分析存在的问题;第三章分析国外政府采取的网络监管措施并且总结了实施效果,从而得出对中国网络监管的启示,为我国网络监管的发展提供有益的可借鉴经验;第四章是综合国内外的经验教训,结合前文分析及现行网络监管体系的不足,提出一些建议,从而完善我国的政府网络监管体系。
[Abstract]:Nowadays, with the rapid development of the network, people's daily life, work and the relationship between the network are inseparable, the network gradually becomes an important tool of people's life, accompanied by people's clothing, food, housing and transportation. In view of the open, safe and risky characteristics of the network, the Internet has brought many challenges to the government network supervision while improving the social living standard. With the rapid development of the Internet, a variety of technical problems, even social problems, such as information leakage, hacker attacks, network infringement, network crime, etc. As the core of social development, the government should not underestimate the power of the supervision of the network, in addition to the formulation of laws and policies, the supervision of other social organizations should also play a leading role. Therefore, the effective supervision of the network is helpful to the benign operation of the network, to the promotion of the government's management function and to the continuous progress of our society. Experts and scholars at home and abroad in different fields have made more and more researches on the network supervision system, mechanism, responsibility and predicament, and have carried on the thorough and meticulous research to the network supervision system, the mechanism, the responsibility and the predicament and so on. This paper attempts to analyze the causes of the problems in the network supervision by introducing the development of China's network supervision, taking the government as the main body, and establishing a complete supervision mechanism. In addition to the introduction, this paper is divided into four parts: the first chapter about the government network supervision related theory overview, explained the network supervision and the government network supervision definition, simultaneously has carried on the analysis to the network supervision principle, the pattern characteristic and the evolution process, has carried on the analysis to the network supervision principle, the pattern characteristic and the evolution process. In theory, the theory of cyberspace regulation, governance theory and freedom of speech theory is used as the theoretical support of this paper. The second chapter first analyzes the current situation of Chinese government network supervision, then from the laws and regulations, the main body of network supervision. The third chapter analyzes the network supervision measures taken by foreign governments and summarizes the effect of the implementation, so as to draw inspiration to China's network supervision. The fourth chapter is to synthesize the domestic and foreign experience and lessons, combined with the previous analysis and the shortcomings of the current network supervision system, put forward some suggestions, In order to perfect our government network supervision system.
