论我国政府工作报告的双重功能及其协调

【摘要】：政府工作报告由"面向"过去之施政报告及"面向"未来之施政方针构成,规范层面的诠释使其表现为一种监督方式,而实践层面的展开将其形塑为一种施政形式。与此相对应,政府工作报告之功能亦有二:监督功能与施政功能。前者的实现方式为人大通过听取和审议政府工作报告,对政府进行监督和控制;后者表现为政府工作报告中的施政方针,在实质意义上乃是执政党和政府今后若干时期内的施政纲领。此二功能统一于政府工作报告的法理内涵之中,不得有所偏颇。然而,实践中所呈现的样态却是对施政功能的过分偏重,对监督功能则有意或无意地漠视,致使监督功能为施政功能所不当消解。鉴此,须借由认识的转变和制度的完善进行纠偏,以实现政府工作报告之双重功能的协调。
[Abstract]:The government work report consists of "facing" the past policy address and "facing" the future policy objective, the normative interpretation makes it a kind of supervision way, and the practice level develops to shape it as a form of administration. Accordingly, the function of government work report also has two functions: supervision function and administration function. The former is realized by the National people's Congress supervising and controlling the government by listening to and deliberating on the government work report; the latter is manifested by the policy objectives in the government work report. In essence, it is the policy agenda of the ruling party and the government in the future. These two functions are unified in the legal connotation of the government work report, and must not be biased. However, in practice, it shows too much emphasis on the function of administration, and neglects the function of supervision intentionally or unintentionally, which results in the improper elimination of the function of supervision by the function of administration. Therefore, it is necessary to correct the deviation by the change of cognition and the perfection of the system, so as to realize the coordination of the dual functions of the government work report.
